Contents insurance claim?

No contents insurance but can a claim be made against neighbours bricks and mortar insurance.?

  • Landlord owns 11 properties in a converted house. A flat on the top floor catches fire and the brigade put the fire out and flood all other flats in the building. If I have no contents insurance, can I claim for damaged posessions against the landlords bricks and mortar insurance given that the problem was caused from a flat above. If I had contents cover, I assume my insurer would want to make a claim against my landlords bricks and mortar insurance policy.

    Depends what your tenancy agreement says. Very unlikely you can claim, I'm afraid - the landlord isn't responsible for the incident, and the fire brigade don't pay for water damage when water is essential to put out the flames.

I think you may have a claim. The "Prime Cause" of the damage to your flat was the fire in the top flat. Therefore, I believe you may have a claim against either the Landlord or the occupier of the top flat. You should speak to a solicitor or your local CAB.

The answer is in your lease. If it includes a "hold harmless agreement," you are toast. So to speak.
