Phone was stolen from work, and is on CCTV, is my work required to help out ? ( phone and insurance related )?

hello, my coat which had my 2 month old Samsung Galaxy S2 and wallet and bag were stolen from my work by customers. I had just had my lunch and had left them on a seat where customers could relatively go but rarely do, by the time i had come back to collect them about 2 mins later they had been stolen. We have CCTV at work and it showed the customers in plain site stealing them. I cancelled my card right away and blocked my phone and gave Vodafone my imei number to make my phone useless to the thieves. My boss burned a DVD of the CCTV for the police who came by after we called. after a day or so, the police called me to ask for a detailed description of events. I told them all of this and they asked if my phone had insurance, i did not because i had just got off a free trial and was waiting till the end of the month to get a good deal on insurance. He Suggested to talk to my work, and tell them to cover it with the work insurance they have. My question is, would my company be liable to get me a new phone or as such, since it was at the work premises, on CCTV and i don't have a locker of any sort to store my stuff in?

Answer:
No, work is not required to "help out", no more than YOU are required to "help out" if my coat gets stolen on your front porch. Not only is work not "liable" for the criminal action of a customer, but their insurance won't cover your stuff.

You'll have to ask your employer. That said, YOU have some liability for your loss as well as you left goods of high value out in the open and unsecured.

The company that employs you has no responsibility here. You left your property in an area open to the general public and left it unprotected, that was your own fault (sorry, it's the truth and you know it, even if you don't want to admit it here). The property is not customer property held by the business (bailee's insurance), nor is it property owned by the company (property insurance). You are out of luck here. Even if they did have some coverage, it would be way under any deductible they have. Sorry, understand I am just trying to be honest and have no intention to offend.

I'm not sure what your employer's policy is for personal items but I'd guess that they, like many employers, limit their liability through policies about personal items in the work place. If you go through your employee handbook and the various policy documentation, I'm guessing you'll find disclaimers about any responsibility on their part. To relate a similar situation, my daughter's cell phone and iPod were taken while she was in school in the middle of a class. The school had no responsibility for the items and while we recovered the phone, the iPod was gone never returned. The school response was that children have been told not to bring items of value, especially electronics (which are also restricted due to classrooom distractions). Our phones have insurance so even if it wasn't recovered, we'd have only had our deductable to pay to get a replacement. We never did check to see if our home owner policy covered theft of personal property outside the home (something I'll have to do when I get home later today).
