State Farm attempting to sue?

Let me explain the situation: I'm asking this to get more info for my parents, they will be going to the insurance office tomorrow. My family purchased a new vehicle in the year 2000 and in about 2001 or so we were insured by State Farm and my cousin got into a car accident in our vehicle. That was ok because we had full coverage and the insurance would take care of it. The other vehicle had close to no damage. I was about 10 years old when this happened and was in the vehicle with my cousin and brother and I still remember everything and exactly where. The point is, my parents were paying a deductible and paying State Farm to take care of the accident. Fast forward to today, about 11 years later and my dad receives a letter in the mail stating he is being taken to court by State Farm. The Court Appearance just states the amount being sued for, the defendant (my dad) and State Farm. We do not have State Farm and haven't had them for years, we dropped them a few years after we thought everything was settled for that accident. We now have Allstate Insurance and are just trying to figure out what is happening considering we have not received anything from State Farm and just received this letter to appear in court. What is happening? And why almost 11 years later? That large claim of money could only be linked to that accident, we never had any other issue that required State Farm to get involved with besides that.

WHO said it was "ok" because you had full coverage? Sounds like that was a GUESS. I don't know any statute of limitations that goes 11 years. I'd say that you don't have the full information on what's going on here.

I totally agree with Yahoo User. Call the State Farm attorney to see what this is all about. You might want to post your state. But without more information no one here can help you. Is there a date of loss on the paperwork? A claim number? I doubt it is related to the 10 year old accident. But you will have to call the State Farm attorney or have the insurance agent do it for you.

This could pertain to a totally different matter, and you are assuming it pertains to the accident involving State Farm 11 years ago. Since the statute of limitations has long since passed, it more than likely involves another matter. Look at the lawsuit papers. Who is listed as the Plaintiff? The suit papers will also ALWAYS list a CAUSE OF ACTION, and usually list a DATE OF LOSS as well. It will also state a dollar amount that they are suing for. Is it possible this is not a lawsuit? Is it possible these are "legal papers" of another kind? For example, this may be a Subpoena to appear? That means he is required to appear in court to provide testimony. It could be that he witnesses an accident that is now in suit, and his name was on the witness list for some other accident. I believe it is also highly unlikely that State Farm would start with a lawsuit. That is not how it is done. They will start with a demand letter. The lawsuit is only the last resort. It is also possible that they have sued (served) the wrong party. If you Google your dad's name, you may find dozens of people with the same name. By the way, you did not indicate what state you live in. State laws vary greatly from state to state. Recommendation: Call the plaintiff attorney, and ask him about it. Find out how what it would take to settle this out of court.

check the statute of limitations. I think time ran out. In this state you have 12 months to file. BUT if they are claiming insurance fraud (sounds like they may be) then you need to contact your agent from that time and see what they know. They will be able to find out everything about it. If they claim they don't know, then it really they DO know and can't comment.

You would need to read the court papers as to why/what state farm is suing your parents for to have a bettering understanding of what is going on.
