How long should an employee self evaluation be?

Am I an employee or am I self-employed?

  • I own an incorporated business, but I am the only employee. I did this for tax purposes, so obviously for that I would like to be an employee. But I have suddenly found myself needing to purchase health insurance for my family, and in that case it would benefit me to be self-employed? Can I pass myself off as self-employed for insurance purposes? Legitimately, of course. I'm not looking to defraud anyone.

  • Answer:

You can try for group coverage, but without another employee, you won't count as a group in most states. The minimum for small group health insurance is at least 2 employees. You are a business owner, for the purpose of health insurance, you count as an employee. This answers your question, but I listed the bigger issue first.

If your C corp pays you wages, you are an employee of the corporation. If you work ONLY for that corporation, even if they don't pay your wages, you are STILL an employee. It doesn't matter when you're buying an individual plan, if you are self employed or not, so there's no need to lie about it. It's the same plan. Go talk to a local agent in your town, and they'll explain how it works to you.

You aren't self-employed; you own a business and you are an employee. To pretend anything else is just that - pretence.

Be careful of insurance fraud. Talk to an adviser.
