How do I remove an unpaid insurance claim that was an inquiry?

  • I called my home owners insurance company with an inquiry about some thefts on my street. This generated an "unpaid theft" claim ( was not told about any claim being generated) which is preventing me from getting insured else where. The company sent me a letter saying that I had withdrawn any pursuit of the claim the same day and said that that should satisy any questions but that they also could not state that it was an inquiry. My potentially new insurance agent said he would send it in but I didnt like the sound in his voice as he seemed less than optimistic. What can I do!?!?

    WOW. Once it's reported to the Comprehensive Loss Underwriting Exchange, I think it's almost impossible to get it off your record. There is a HUGE difference between a generic inquiry about a hypothetical situation, and a claim that was filed, then withdrawn with nothing paid. At the very least, your company would have to be under the impression that YOU had a loss and that there was a date of loss. A new agent can't fix this. If you DID file a claim, then discover that, for example, your damages were under your deductible, and then withdrew the claim, then this is rightfully on your record. If you did NOT file a claim, and had no loss, and didn't tell the insurance company you had a loss, you can try to sue them in civil court to get this fixed - but it's going to cost you a LOT in legal fees.
