Online Fraud Through My Bank Happened..Now What?? First Capital Bank, Kingfisher, Oklahoma?

Okay I have a question about my bank account: I logged on the 25th of this Month (Sat.) and noticed that I had been hit with over 500.00 USD withdrawal. I didn't approve these transactions whatsoever! I went to my bank that morning at 9am and told the teller at the window what was going on and had a print out of account transactions. She told me that there was nothing she could do, and I would have to wait until Monday the 27th (two days later) to speak with someone about this issue. Monday came and I went into my bank (First Capital Bank) in Kingfisher Oklahoma and told the ***. Bank President what was going on. She told me that it was overseas accounts that had stolden my money, and that during the "two-days" there were more comming through, and I would have to pay for them. There was another 500 bucks comming through!! I 100% told the teller on the 25th and put it in writing to freeze my account, she didn't. So, now it's Monday and I'm being told I have been charged 1,000 dollars for transactions I didn't approve. I ask her why didn't she stop the transactions, and I was told that since it was used by visa debit card that they couldn't sto the transactions, and now I'm out 1,000 dollars!! Nothing could be done for me. It also showed that the same overseas company (which i tried to call) is fake had more "pending" transaction towards my card for another 500 bucks!! I asked if these could be stopped. I was told again no because it was through my debit card. I didn't get the whole sorry we can't help deal until I started surffing the web and talking with people. Come to find out when I spoke with her again on the 28th i was advised(after asking) did this bank have any type of on-line fruad protection,,I was told they did not have that at my bank because it was a small bank(which it isn't) No, it's not an IBC but does have other branches. I was advised to withdrawl what I did have left in my account and leave money in there to cover what was comming through. I got hit again for 500 more!! Now I'm way overdrawn when I checked this morning(about 15-min. ago). My bank is not helping me get my money back, was told rough lesson to learn by using you card on the net by my bank. To make it worst the money i did leave in there for the checks I had out have not came in yet!!. My account was not closed, I'm overdrawn now, owe fees for that, and I didn't even have that much money in the bank for the jerks that took my money. My thinking is that my bank just dont want to own up to helping me get my money back, and why in the world would they let all of the transactions go through. Now they are saying that if the bank did have some type of protection policy i would be okay, but since they don't I'm screwed out of about 2,000 dollars now, plus still have checks comming in, plus over fees! Don't you think that the bank should have closed my account on the 25th when I asked them personaly, and in writing? I think the bank just didn't want to get tuck with the bill myself because they don't have that policy of on-line frud protection. I told them to shut it down on the 25th, and since then 1000 more has hit, I was advised to take my money out, but now I'm over drawn, which checks still out. Going to see her today in about an hour. Would please like some feed-back to shoot at this bank. I should have been protected some how. I will take a loss from the 25th down, but i think just because it was "pending" on the 25th they knew it was fraud and let it go through. This was our Christmas money, and sons birthday, plus bill money..a total nightmare, and all my bank can do it say over, and over.."sorry there is nothing we can do". Can I sue my bank for not closing my account when I asked them? Talked to my lawyer and wants me to call after this metting today. Honestly, I think the bank kept my account open because they seen more big transactions comming through and didn't want to flip the bill. The ***. Bank Manager said,"she sees this all the time in the 10,000-20,000 thousands of dollars and I feel very bad for them people. She said she was almost positive I wouldn't get anything back becuse it was overseas and no way to track them. I myself work for The Sheriff's Dept. Is there a claim i can file with my bank? Is there anything I can do? Should I be held responsiable after the 25th (After making my bank aware of the issue)? I know the bank can't just say..sorry... life lesson... Any help would be great. I asked about FDIC and was told that is totally diffrent, which I understand now after reading about it, but there has to be something I can do for the fact I made the bank aware of it on the 25th and they just let the jerks plug away at my families money until now as it sitts almost 500 over and checks outs. I would contact an attorney, urgently. Your bank can indeed cancel transaction through your debit card, by cancelling the card. Saying that they can't is extremely suspicious, especially given her stories of many other customers losing their money. I'm not legally qualified in your jurisdiction, but contact a lawyer. They can claim the money back, as your bank should be insured against this sort of loss. In any case, allowing these transactions to continue is negligence in the extreme from your bank. Close your account with them forthwith.

First, file a complaint against the bank! It is horrendous that you notified them in writing, & they kept processing these payments to thieves! http://www.state.ok.us/~osbd/Banks/Downloads/downbank.htm File a complaint to the IC3,Internet Crime Complaint Center, against the overseas company. http://www.ic3.gov/about/default.aspx And close your account TODAY!
