STOLEN DEBIT CARD HELP!!!?

So I had opened a checking account over 9 months ago, and they were supposed to send me my debit card in the mail, until then they gave me some temporary checks to hold me over. After waiting for almost 2 months I never received anything, called and was given the run around. Because I did not have debit card I never opened online banking, and never really had a detailed view of the transactions taking place. I had direct deposit from work and checked my balance every so often and it seemed ok. Come today, (almost 9 months later) I go to the bank to make a withdrawl and and -1200 dollars, which is totally impossible. I call the banks fraud help line and come to find out someone had been using the infamous debit card all along, even though I had never seen it, making small purchases at first then draining my account completely. no one noticed this even though I called about not having a debit card. my question is will the bank give me the money back? what can I do to fix this? is there anything I can do to find who did this and take legal action myself? thank you for reading all of this, I'm very desperate.

You need to work with the fraud department at the bank. They may give you some or all of the money back. You also need to check your bank statements every month. Even if you found the bad guy it's probably not going to amount to anything. Most of these cases are never prosecuted.

You have lost your money - will have to repay the $1200 overdraft - because you couldn't be bothered to visit your bank to report the non-receipt of your debit card in person. You were given the run around because not receiving an expected card usually results in a visit to the bank - as opposed to simply calling and hoping for the best
Your responsibility for fraudulent charges increases over time. The exact interpretation of the Electronic Funds Transfer Act may depend on your bank and/or jurisdiction, but generally the clock starts ticking when you receive the statement with the fraudulent charges OR when you learn of the loss/compromise of your card, whichever is first. Then you are responsible for a) no more than $50 if you report the loss or charge within 2 business days, b) no more than $500 if you report the loss or charge within more than 2 but less than 61 business days, or c) everything if you don't report the loss or charge within 60 days. The next time you speak to your bank's fraud department, remind them vigorously that you reported the non-delivery of your card, and the card should have been deactivated, and their failure to act on your report means they are responsible for the fraudulent activity. They probably won't buy it, since the card has been in use "all along" and you never alerted them of any fraudulent activities, but maybe you can make a case that you thought the card was deactivated when you reported it missing so you didn't look at the debits on your statement, or at least that you're entitled to EFTA protection for all the charges since your last statement. Visa/MC policy actually goes above and beyond EFTA and gives their debit cards credit card-like fraud protection. It may be possible to recover even more through their policies. To be honest, I'm not optimistic, but if you don't try you won't get anything so you might as well try. I'm not sure how debit cards are tied in to online banking or the lack thereof. All I have ever needed is my routing number and account number.

Hello, that is when you call and say, my card was never received, please cancel it and send me a new one. No ifs ands or butts about it. But since you are obviously far past this point, there is nothing you can do. How could you not notice unauthorized charges on your statements? The bank sends them every month, you should have had a record of all your purchases in a checkbook register to compare them side by side with purchases on your statement, whether on a check or card. Then, you should have reported unauthorized charges immediately to stop them. However, since you are far past the 60 day fraud repotting time period, your money is gone. If you take it to court, all they have to say is "why didn't she bring this up in the past 9 months?" and the judge will laugh you right out of the courtroom. Sorry, but you've just learned a very exepensive lesson on why it's important to track your purchases and compare them to your statements every month.

Did they not answer this when you called the fraud line? You;re suppose to call them, like you did and file a dispute. They will put back your money, on hold, and do an investigation.
No, you probably won't see your money back. It was your responsibility to cancel the card that did not arrive and have them send a new one. You have to be diligent about your bank account or things like this happen. Now, you will probably be expected to pay back that amount, and if you cannot, your account will be closed and your name will be in Chex Systems which will prevent you from getting another bank account for 5 years.

Thats why you need to review your statements more carefully and dispute unathorized charges right away. You have 60 days to contact your bank to dispute unathorized charges. Like right now if you dispute those charges I really don't think that they will give you the money back

You may have to bear the loss on this one. I'm not a financial adviser but, in most instances, Card companies will only allow up to $50, if you let them know that the card was lost or stolen within 48 hours. Maybe up to $500 if your account was in good standing, reasonable care was used in safe guarding your account and no more than 2 "events" in the last year. I'm sure there's more to this then I'm aware of, but your bank or card company should be able to help you.
