What info do I need for debt validation letter?

Need help with LVNV Funding unidentified debt & garnishment!?

  • I live in the state of Georgia and just received via certified mail garnishment paperwork on behalf of LVNV Funding LLC. These are copies of some of the paperwork sent to the State court of Gwinnett County. It was sent from a John P. Farrell who is the attorney on behalf of LVNV Funding LLC. It looks like I received copies of his letter to the Clerk of Courts, Affidavit of Continuing Garnishment, Summons of Continuing Garnishment, Answer of Continuing Garnishment, & General Civil Case Filing Information Form (Non-Domestic). I see from reading past forums that LVNV Funding can be shady in their collections and I should be aware before admitting to or even contacting them direct. I’m not admitting to this debt by any means but if I had a guess to what it MAY be from, it may be from a past credit card that my now ex-wife took out in my name without my knowledge or consent and racked up countless debt by purchasing Rx meds illegally. We were legally married at the time this took place but this was not and is not debt I consented to. I thought we had everything cleaned up but apparently not. Few other details in my initial research: -I ran my credit report (which I should’ve done a LONG time ago) and there is no account with the judgment amount listed on my actual credit report account history, the only thing listed is the judgment filed from LVNV funding back in 2006 under the “public information” section. I can’t even tell what account it would stem from since LVNV Funding is place that buys other companies debts. -I will need to find more info I’m aware but at a guesstimate IF this is from my ex’s situation, this was 4-5 years ago now. Does anyone specifically know the statue of limitations to collect this debt? And if they really filed this judgment back in 2006, of which I have no document of nor received unless my ex did and tossed it on me, does that constitute with the SOL? -I checked with my HR dept at work and they have no record of any garnishment info being recv’d so it hasn’t reached there…yet. Even the location they show listed as my employer is not an address anyone at my work or in corporate even knows about. It’s an invalid address so wherever they’re sending this supposed info doesn’t exist. I’ve worked for this company for 15 yrs and am well aware of our locations plus I double checked. My questions are: 1) What is the best way to find out where this debt is stemming from? 2) How long before they will garnish my wages or what can I do to postpone this from happening while I dig to find the source to dispute? 3) How do I dispute the charges? I have no idea what card this came from so I have no idea even how old the account is. A best guess would be about 4-5 yrs old. I basically need to know the best steps to go through trying to identify the debt, stop this garnishment in the meantime, and dispute the charges. I appreciate the info. Genuine answers only please I do not need nor want to be berated for what I’ve already identified as stupid, past decisions. Thanks again.

    the judgement reported on the public records section should state what court they got the judgement from. most judgements are done in a county court. not state. unless its a hugh amount. lvnv is one of the worse in the country. its possible all that paperwork is false. see,ms to me if they never recieved money from your employer because they didnt have an address then they would have took your bank accounts. dont call them there should be file numbers and court dates somewhere. they might be trying to trick you into reaffirming the debt.
