Redundancy help - what happens if the Co you work for goes bankrupt but then employs you from his new company!?

Hi, Any help or advice would be really appreciated! I've worked for the same company since Oct 1996 but in June 2002 the company went bankrupt! I asked for redundancy at the time but my boss decided to take me on to work for his new business, so I didn't get anything! At the start of Jan 08 I went on maternity leave, due to return to work in Jan 09. I have since been told that due to the credit crunch & re-location of the business my job is now redundant! The 'total' amount of years that I have worked continuously for the same person is 12! I've been sent a letter detailing my redundancy package but it looks like they are only paying me for 6 years of service (so from when they took me on again after the company went bankrupt in June 02 till Jan 09). I feel that I am entitled to redundancy payment for the full 12 years as I have been working for the same person for this amount of time & have been very loyal! Does anyone know if I am able to claim to the full 12 years? Thanks in advance.

I dont know for sure the answer to this but it sounds to me like they only owe you 6 years. You have only worked for your current company 6 years, I cant imagine it makes a difference who the owner of the company is and whether you have been employed by him for any length of time. It goes by the company, not the owner.

You could point out to your employer that it was illegal of him after a bankruptcy to start a new business within 3 years! He may decide then to pay you your full wack!! Perhaps he has taken a second bankruptcy, like the first, to get rid of creditors and start again!!

You were cheated. Taking you into a new company is a change of employment so would not affect your right to redundancy money from your first employment. If your boss went bankrupt it would be illegal for him to immediately set up a new company. However, this present company is a separate entity to the first one and cannot pay you redundancy money for time worked at a different company. Basically, he gave you a job to save paying you redundancy money - which as he was going bankrupt he probably did not have anyway.

I think you got 'diddled' when you moved with your boss, you should have got redundancy then for 6 years then gone to the new company. So now you will only get it for 6 as its a completely different company regardless of the owner. And being 'Loyal' means nothing, if a compnay goes bankrupt the government pays your redundancy and will have been told by administrators peoples length of service. Hope thats helps!
