Is this commission based pay structure illegal?

I worked for a certain new corporate appliance store Virginia and think how they figure draw may be illegal. We were 100% commission based. If you work under 40 hours you get 7.25 against draw for every hour. If you work 40 hours and 1 minute or above, every hour for draw goes to 1.5 times. Example: I worked: 33 hours I had a sales goal of 33hours*7.25= $239.25. If I worked 41 hours my sales goal was 41hours*7.25*1.5= $445.88. What I think it should be for 41 hours is: (40hours*7.25=290) + (1hour*7.25*1.5=10.88) so my goal is $300.88 This is a 145 dollar per week difference in this example. It made my wages higher, but not having insurance I was claiming making a lot of money and was unable to get free health care, this sucks being a type I diabetic. We got paid this amount, so I can't sue for losses, but we had to pay it back and got harassed for constantly being in draw when I believe we should not have been in draw. They claim that under a 7I exemption is this allowed but I read it and don't believe this to be the case. I am filing with the Dept of Labor right now but want to make sure I am understand this correctly. Any help cutting through the corporate red tape BS would be much appreciated! Thanks!
