Questions on Contesting A Speeding Ticket in Comal County Court at Law. 2nd trial.?

• I was given a speeding ticket while going to Comal County. 84 on a a 60. I contested the ticket in Comal County but lost the case so I appealed to the Comal County Court At Law. Ticket was given on 24th of Oct 2004 while the lower court heard the case on June 2005. It is almost an year before the County Court at law have called me for the trial. Question a) Can I ask the court to dismiss the ticket because of lack of fair and speedy trial. ( if it is allowed in tx as it is taking them almost an year to call me in the court for the ticket.) There are no radar records maintained. Can I ask the court to show me the radar records and if the officer can not show it can the ticket be dismissed. Officer gave the wrong version of the situation in which ticket was given. Can I use that as an alibi for the ticket to be dismissed. Can I appear in the court and ask for a court appointed attorney or since I do not have an attorney can the jury trial be postponed until I get an attorney.

  In Texas, a ticket is supposed to be dismissed if any of the information on the ticket is incorrect. I do not know if they buy that after 2 years though- why didn't you use that when you first got the ticket? I think you should get an attorney and quickly. It is difficult to plead that you did not get a speedy trial if you then turn around and ask for more time. Honestly, it sounds to me like you were guilty 2 years ago- you have come up with way too many reasons why the courts were wrong and none that say you were not wrong. Pay the ticket and quit wasting taxpayers time and money and let the courts fight about things that matter. P.S. SLOW DOWN!!!
