When do you begin wearing a Postpartum Support Belt?

Got seat belt ticket for pasenger not wearing seat belt in CA.?

  • We were at a red light and her phone fell off the holder on my side of car. She reached down to get it but the seat belt stopped her. she took off seat belt to get the phone so that it would not roll under my foot and make a accident. I then reminded her to put back on her seat belt. At this time a motorcycle officer turned on to street because his turn light turned green he then made a u turn. And came up behind us and pulled us over. She had on her seat belt before I moved the car. Isn't the law that I have to make sure all passengers have on seat belts before we would move? I did my part and yet I received a ticket. What are your thoughts? She didn't want her phone to get under my foot and make an accident and since we were at a red light we could not move over to the side of the road to pick it up. I know a ticket is better than an accident but the law says my job is to make insure pasengers have seat belts on...which I did and she did when I reminded her to get it on before I had to move with the green light.

    fight the ticket. in some states. it is LEGAL to be pulled over just for a seat belt infraction. bring your passenger with you, explain to the court what happened. remain calm and dont get angry or anything. the system is pretty much black and white, but if you show maturity and responsibility they will see your side of the story and might let you off.

I think you have a good case in which you may well win if taken to traffic court. Remember the officer can only react to what he sees at the moment not make judgments about what may or may not have precipitated the infraction. In other words, you have reasonable extenuating circumstances but such factors must be argued in the forum of court. Best of luck.

The law also says that an officer can not pull over for just a seat belt. If that is what you got the ticket for he was in the wrong.
