When do you begin wearing a Postpartum Support Belt?

Hi I got a seat belt ticket for wearing it under my arm, Can I fight it?

  • I know it was wrong for me to not wear it properly. I could get hurt blah blah but lesson learned they called me out on it. But I do not want to pay 101 dollars for their tip to keep it above my shoulder. Here is my grounds. Florida seat belt law is as follows: (b)() "Safety belt" means a seat belt assembly that meets the requirements established under Federal Motor Vehicle Safety Standard No. 208, 49 C.F.R. s. 571.208. (c)() "Restrained by a safety belt" means being restricted by an appropriately adjusted safety belt which is properly fastened at all times when a motor vehicle is in motion. (4) It is unlawful for any person: (a)() To operate a motor vehicle in this state unless each passenger and the operator of the vehicle under the age of 18 years are restrained by a safety belt or by a child restraint device pursuant to s. 316.613, if applicable; or (b)() To operate a motor vehicle in this state unless the person is restrained by a safety belt. (5) It is unlawful for any person 18 years of age or older to be a passenger in the front seat of a motor vehicle unless such person is restrained by a safety belt when the vehicle is in motion. This does not state that properly fastened means over the shoulder or any other way just says "properly" and law is all about what the laws actually say. What should I do?

    c)() "Restrained by a safety belt" means being restricted by an appropriately adjusted safety belt which is properly fastened at all times when a motor vehicle is in motion PROPERLY FASTENED. When it is worn incorrectly, that states it is equal to not wearing it at all. That regulation alone will cause them to win the case. Just pay it and continue on

The law also does not say what "seat" means. They do not have to define every word. "Properly" means the correct way. It does not mean however you want to wear it. The way you wore it is not "properly".

No you can't fight it as you weren't wearing your seat belt properly.
