Speeding + Racial Profile?

SPEEDING: CLOCKED BY PATROL VEHICLE "super speeder"? Good evening everyone, so I need some help in regards of ticket I just received two days ago. I live in Georgia, and GA has a fairly new law its call SUPER SPEEDER, any time you go above 80 on a 4 lane highway you are consider super speeder and they had $250 to your ticket. which I think is fair. Wed. night I am coming from, i work 25 miles away from my house. There was some traffic between one exit and the other one so i decided to switch lanes on and off to get out of the traffic. Once, I finally get out, i get on the last lane of the highway (not HOV) and I just kept going heading home. I get pull over by police officer less than a 1/4 of mile next to the exit i need to get out. Police officer: Good Evening Sir, Me: Good evening Police: Do you have A license? Me: Yes, I do have a license why am i emphasizing this? Ga pass a law in regards of illegal immigrants as of July 1st, 2011. Which pretty much gives the right for an officer to stop any one who he thinks is not legally in the country and ask for documents. I've been stop before and I have NEVER been asked do you have "A" license?; i've been told do you have your license?, may i see your license, can i see your license, license and registration?. THe minute he did this I felt profile because i come from a Latin America, and he did this the second i turn around and saw my "hispanic face". I gave him the license, and then he went on saying that he was following me from Jimmy Carter, to Suwanee which is about 12.3 miles, and he said i was speeding and switching lanes all the time. NOT TRUE, i switch lanes for about 2/4 mile just trying to get out of the jam, but from there it was a steady speed until i got pull over. I said, sorry just really trying to get home, long day at work... "do you know how fast you were going?" No sir, i was going with the traffic. OK. Then!!! he goes into saying, "how many drinks have you had?", again to my point, i've never been told "how many drinks have you had", i've been asked, have you drink tonight? , again i felt that the officer WAS ASSUMING I drank!! which again leads to the fact of profiling! My response was easy, sir I don't drink, if you like i will be more than happy to step out the vehicle and blow the "thingy" (don't know the name). He said "mmmmm" and then he just told me to staying in the car and left... HE NEVER TOLD ME, HOW FAST I WAS GOING 15-20 minutes later.... comes back with a ticket, (which i was ready for, not arguing no nothing, i said maybe i was 5, 10 over..). The ticket stays 24 OVER!!!!, as soon as i saw this, i was extremely upset because i know there was no way I was going this fast. I mean he could have said 25! and charge me with reckless driving right then and there. I go into asking him some questions: How did you clocked me? "my speedometer is certified", why didn't you stop me before if you were following me since jimmy carter? (12.3 miles later) "I was trying to catch up with you! ", if you say i was going this fast since Jimmy carter why are you stooping me now? " i never said that, i said i was trying to catch up with you.... i let it go, and said ok thank you. officer says bye and leaves... When i get home look at the ticket careful he writes on the ticket that my car is gray.. MY CAR IS BLACK PEACH BLACK!!! tinted BLACK WINDOWS, BLACK RIMS, BLACK LEATHER FULLY BLACK!! night or day my car is black!! so here are my questions: 1: If I felt profile the minute I was stop because of my race, and the new law, can this also helped me to drop the ticket? 2. Officer NEVER told me the speed before he left. 3. Why would he wait 12.3 miles to stop me.? can i use this against him? 4. If he was trying to "catch up with me", why didnt just use your lights everyone moves, and stop me right there and then. 5. The tickets say';s clocked with patrol officer car, how accurate can this be? he was behind me for about 5 miles or so, and there were cars that were right next to us going at our same pace!!! 6. if he cant even tell from the color of my car, how can he tell how fast i was going?? I really need some help, first thicket since 3 years ago, and this can really ruin my record with the insurance not even counting the $ I'm going to have to pay for the ticket itself. First off how long have you been in this Country that you STILL speak what is basically broken English on Yahoo? Could it have been your accent and your comments that had him thinking you were drunk? Instead of instantly screaming profiling maybe you should consider other reasons for it. The way you were behaving when pulled over leads cops to think you may be drunk or on drugs. Now I am not saying YOU PERSONALLY, but I'm saying cops look at body language. 1)NO if you broke the law it doesn't matter why you think you should be allowed to break it. The ticket is for breaking the law, not for being a foreigner. 2) He told you WHY you were pulled over, the charges against you. I am not aware of them having to tell you your speed. Last I knew if you are pulled over AND ASK WHY they have to tell you. Although I think most will tell you before you ask if they have to catch you(as oppose to spot checks). 3) He TOLD YOU WHY. He had to CATCH YOU. You can go to traffic Court and claim he could have caught you sooner. He will say he couldn't. The Judge will believe him. 4) Not everyone moves when they turn on their siren and lights. 5) If you were clocked by his CAR that would mean the speedometer. If it was "radar" they are very accurate. A cop could demonstrate how they target the specific vehicle, I've seen it done(not pulled over so never saw it in person). 6) Nice try but it won't hold weight in Court. Don't even waste time bringing that up as you will look foolish

1. Your feeling that it was profiling cannot help to get the ticket dropped. If it really was profiling, and there is real evidence of that (more than the fact that he asked if you had a license), that might help. 2. So what? 3. Because stopping someone on the highway in heavy traffic is dangerous. If possible, he should wait for somewhere safer. 4. Not everyone moves. And, sometimes, someone sees the lights, tries to get away, and hits another car. 5. A regular speedometer is accurate to within plus or minus 5 mph. A certified calibrated police speedometer is more accurate. Enough that if it said 24, then you were definitely at least 20. On the other hand, it is not so accurate to say whether it was 24 or 25. You got a break. The penalty for 20 and 24 is the same, and the penalty for 25 is much worse, so writing 24 gives you the lowest possible penalty for the range of speeds consistent with his speed reading. 6. Since he was behind you for 5 mph, he was going the same speed as you. His car has a device that tells him the speed he is driving. It does not tell him the color of your car.

ask judge to get video from the cop's camera which they all have in the front of their vehicle to even see if it was ur car. (I would ask as soon as possible because they might erase tapes soon) not trying to take his side, just if people talk a certain way in general that can happen. or he might have thought he said one thing and meant slightly the other, he is only human regarding the talking and such. goodluck with ur ticket, just keep asking for proof of ur speed if they do then i guess they do. but the racial stuff idk if that would help.... idk if that might sound like ur trying to say this like black mail them to get out of a ticket idk that doesn't seem right..... my sure recommendation might want to call a lawyer even if u don't want to use one in court they might give u advice over the phone.
