Is it really against the law to avoid traffic cones?
-
i was on my way home from pigeon forge and the navigator said to turn where there was traffic cones. well i started to turn then realized i couldnt cuz there were cones in the way and i couldnt back up cuz i was already in the middle of the road and there was a cop coming out of the road i was trying to turn into and jumped out of his vehicle and was screaming at me and said " did u not see the cones." i said i did but it was too late. he had already made up his mind he was going to write me a ticket, cuz it was the 4th of july and apparently he didnt want to work that day. well anyways the ticket is for 80.00 and i was just wondering if anyone else has come across this and what do you suggest i do, go to court and fight this, which is bout 4 hours away from me or just pay the damn thing and would you think this would be on my driving record?

Answer:
Hmmm...sounds like it wasn't the best encounter with Pigeon Forge's finest. But I would advise just paying the damn thing. The time and expense off of work, of driving such a distance (and back), mostly with the prospect of the judge just saying, "Pay up," just isn't worth it. And technically...you were in the wrong. As for it appearing on your driving record, I'm not sure how it works there, but I suspect something will be on your record for a while, anyway. Unless you're into other illegal activities and this could help nail you, I wouldn't worry about that too much. Just about every driver in America has something as silly as this hanging on his/her record; it really doesn't have much weight in the overall scheme of things.

GPS does not substitute for common sense. You've got to use common sense. You got the ticket for not using common sense. If you want the judge to embarrass you in traffic court, go ahead and fight it. You'll lose. Expect the judge to pose this question to you: "If your GPS told you to drive off the Grand Canyon, would you follow the instructions?"

You was in the wrong so you have to pay the ticket. Your excuse is that the navigator said to turn there? What if it said to drive off a cliff? Maybe you should contact the navigator co. about paying the ticket.

It's a civil infraction so it probably won't be a point your license. Why wouldn't he be able to write a ticket? You most likely impeded traffic by not paying attention. Granted, I think he overreacted, but I don't think you would win this case. Call the court and see if you can pay it by mail first.

umm, i dont think its illegal, and that you got a ticket.. its bs.

cops scream at you for crossing some cones ( I have seen similar on many occasions) but treat murderers and billion dollar fraudsters with politeness and courtesy , what a strange country this is turning into, if it goes on your record fight it, if it doesn't pay up and forget it but judges side with the cops on zero evidence - again strange country

Being a moron isn't a defense for driving like a moron. The cones weren't there to make the road pretty there was probably a good reason they were there such as: rock slide, flood, parade route, alien abduction, etc.

What specifically is the ticket for? I'm guessing it was something like inattentive driving. You might be able to fight it, but for the cost and hassle it might just be cheaper to pay it.

If there were no warning signs before the turn and the cones could not be seen then I say that you fight the ticket but since you are 4-hours away just pay it.
