Question about the provisional license law in California?

  • I'm 16, and the California DMV states that within the first year of obtaining your provisional drivers license you are not permitted to drive people under the age of 20 without an adult present. My parents allow me to give rides to my friends all the time, even though I've only had my license for about 4 months. I were to get pulled over and I had one of my friends in the car, the cop would definitely ask to see my license and then see that I haven't had my license for a year yet. My first question is, what is the penalty for that? My second question is, could my friend in the car tell the cop that she is 18? (or 20, I'm not sure what the legal age is for that circumstance) Is there any way the cop could ask to see my friend's ID, even though she wasn't the one driving? I was kind of thinking that there would be no real way for the cop to prove that my friend is underage considering she wouldn't have been the one driving therefore she doesn't need to carry around identification with her. Does anyone know the answer to this? Thank you!

    http://www.merriam-webster.com/dictionary/provisional " serving for the time being : temporary " You will be driving illegally. Cop can keep your license and impound the vehicle. You walk. You don't get to drive legally again until you pass 18 years of age. It takes at least 3 days to get the car out of impound. Provisional means *you* have to prove that your friend is old enough.

If you go to the official ca dmv website, you will see the current rules. You can never legally drive from 11pm-5am on a provisional drivers license If you get caught, you can't get your license back until you are 18. Your parents are foolish to allow you to break the law. Point one. Mom can't give you permission to break the law. V C Section 12814.6 Provisional License for Minors Distinctive Driver s License (1) Except as specified in paragraph (2), during the first 12 months after issuance of a provisional license the licensee may not do any of the following unless accompanied and supervised by a licensed driver who is the licensee’s parent or guardian, a licensed driver who is 25 years of age or older, or a licensed or certified driving instructor: (A) Drive between the hours of 11 p.m. and 5 a.m. (B) Transport passengers who are under 20 years of age. It goes on to fines, $35 for a first, $50 for subsequent, and license revoked, and other bad things. Read the link below, and don't do it. And yes, if your passenger appears to be under age 20 they can ask for ID from the passenger, driving or not.
