Left hand turn / one-way stop collision - who is at fault?

This involves a two-way road. My lane split into two- a left turn lane and a straight lane (no stop sign), so there were actually three lanes at the site of the collision. The opposing lane has a stop sign to allow the people who are making the aforementioned left hand turn to go. As I do every morning, I put my directional on and entered the left turn lane. There was an opposing car stopped at the stop sign, as there often is. This person, however, must have not realized that they were the only one with a stop sign. As I took my left hand turn, the other driver drove into the passenger side of my car. Immediately after the collision, she expressed confusion as to why I did not stop. After telling her that I do not have a stop sign, she said I was going faster than she thought. Then she also added that it's difficult for her to break because she drives a standard. When the police officer arrived, he stated that she was at fault and that I had the right of way, but he did not give her a ticket. This leaves me with the issue of trying to get the other driver's insurance company to pay for my damages. She is claiming that she was already in the intersection when I started to make my left hand turn. However, if this was the case, it definitely would have been me that ran into her. The damage to both cars (to the passenger side of mine and direct front bumper of hers) along with a look at the intersection clearly demonstrates how the crash happened. Her insurance company is trying to say that I am completely at fault for the collision and 100% liable. Did I not have the right of way? Does anyone have any advice about how to deal with this situation? Thanks Note: Unfortunately there were no witnesses.

Answer:
I would call the police and explain the company refuses to pay even though the accident was blatantly caused by the other driver. They will then be able to help you in resolving the issue.

Get the police report. The cop stated it was her fail. Pretty much done there. Besides she had a stop sign, you didn't. Done. If she was in the intersection already, did you drift in the front of her car with your passenger door? Just get your insurance involved.

Unfortunately, you may have to claim that you were injured in the accident, and hire an attorney. It's the only way to get paid, because the officer did not issue a ticket.
