What to do if an aggressive driver runs you off the road on purpose?

  • This morning I was driving to work and a Truck driver tried to cut me off when coming onto an on ramp on I-75/I-85 in Downtown Atlanta. After I merged the truck driver (18 wheeler) started aggressively tailgaiting me, so I tapped on my breaks to get him off of me. After there was a little seperation the driver pulled two lanes over and started picking up speed very fast. At the fork of I-75 and I-85 the driver merged over two lanes to the left lane and tried to hit me, and ran me off the road. I followed the driver and called the number on the back of his truck and reported the incident with his company after finding the number on the back of his truck. The lady thanked me for reporting him and said she would file a complaint with his manager. After talking with family members about the incident, my Dad mentioned that this was probably on camera. I will not be satisfied with some slap on the wrist from the driver's company. I am not looking to sue the company, rather make sure that this driver loses his commercial license. What steps, if any, can I take to go about trying to make sure this happens? Thank you for your input

    The way it's written it sounds like YOU cut him off when entering the highway from the on-ramp. Ramp traffic is supposed to yield to highway traffic, so if you sped up - you did the initial cutting up. While it sounds like that truck driver had a case of road rage, there's something else that sticks out to me..... How in the wide world can anything come across two lanes - and you still be in a hazardous position when it gets there? You have NO grounds to sue if you didn't file an accident report. You filed a complaint with his employer. What happens (if anything) is up to his employer. You will NOT be able to get his license pulled. Before talking about restricting others, very carefully examine yourself. There are a number of things you did that aggravated the situation. Someone that cuts too close in front of me and then flashes brakes to tell ME that I'M too close ticks me off a bit, too. We're all better off if you learn to try to avoid a situation instead of getting your own petty revenge afterward.

Traffic already on the highway is not required to move over or slow down so you can get on the interstate. Not around Atlanta, nor in any state. It is the sole responsibility of the party getting on the interstate to match the speed of traffic and adjust their position to line up with an empty spot. Go reread the driver handbook, your turn signal should be on as you start down the ramp, turn your head and check the flow of traffic. As you near the end of the ramp, your speed should very near what traffic is moving, you now let off just a bit and fall in line behind whomever is next to you. Also, think zipper. Don't try to ride the rear of the vehicle in front of you into traffic, take your turn just like the teeth of a zipper. People around Atlanta don't seem to remember that trucks are prohibited from the inside lanes, they race up ramps and try to jump in front of trucks from that big blind spot on the right side. It sounds from your narrative that you did just that. The blame rests on you, quit your whining! It seems entirely possible that you are better suited for public transportation than in your own vehicle. Have a nice day.

So sorry for this rather dangerous encounter but this is a legal matter and since you did not get the police involved there is little that you can do at this time and as of now it is all that can be done. For more aggressive move on your part you would have to hire a lawyer and allow him to present this to the trucking company looking for a settlement vs. going to court to provide relief for you experience, if that is possible to do under state law. I cannot think of anything else. I also have encountered this problem and, by the way, tapping the brake is the recognized technique to indicate to other drivers that they are too close. I sometimes use the hazard light. As people tailgate as a matter of norm they just do not realize how close they drive. If there is a next time, just get away from that vehicle as quickly as possible. It is not worth the hassle and the bully driver will not change his ways. Best wishes.
