Will my insurance company pay for the damages to my car?

I was in a car accident and the other insurance company wont pay full amount of damages?

  • I was in a car accident on NOV 24, 2011 it is no DEC 13, 2011 and after all this waiting the other guys insurance company told me they will only give me half.... was coming out work parking lot he then backed up and hit my front end we both said ok deal with it on lunch break so we get back he call his insurance company i call mine and mine said go through his cause he is at fault and so i do and he got on the phone and admitted fault. so they said ok send it there and they get back to me. now all this time passes and they said since there was no police report made they can only cover half the damages witch is 500 dollars. witch makes no sense if they dont cover it why even pay half?? his car insurance company is direct auto insurance. i need help to get this paid, cause my deducable is 500 dollars so i don't want get stuck with paying that much since i was not at fault and he even admits fault.

The one thing you did right is that BOTH of you reported to your own insurance companies. If you want your damages paid, YOU must have your insurance company fix it and pay your $500 deductible. Then YOUR insurance company will go after HIS insurance company for your deductible plus what they paid, since they will have a "vested" interest. The fact that it took 3 weeks for them to make a decision would not be uncommon, since no police report and verifying the damages plus both of your statements. You have another problem going against you, since you have front end damages and he has rear end damages, so it could be "construed", you rear ended him, so they are not paying in full. He may have admitted fault, but if the police had came and filed a report stating that he did in fact back into you, would make your case stronger. You paid for insurance, so now let them FIGHT for you, since that is what you are paying premiums for. Here is a question for you to think about? If they pay, how much less will you be getting? Is it more than $500? Then it is a no brainer, since as it stands, you will be out of pocket $500 or more. good luck
