Who applies in car insurance, the owner or the driver?

I was in a car wreck, the driver had no insurance but the car did, any one been in this situation before?

• The driver had no insurance but the car owner did. The driver called the owner (his boss) and got the insurance information from him directly and had permission to use the car. The insurance adjuster gave me the run around on Friday, the accident happend thursday. On Friday they said they had not talked to the owner of the policy to see if the driver had permission to drive but then told me that this Tuesday I can meet with their appraiser, why would I be able to meet Tuesday if she hasnt already talked to the owner? Seems fishy to me. I dont think the adjuster is acting in good faith, can I have the insurance company switch my adjuster? Also who would I sue in small claims court for property damage if I dont agree with what the insurance company wants to pay.

  Insurance companies are notorious for giving the run-around. Be diligent and follow-up (harass) the adjuster - if the car was covered, your damages should be covered. Doesn't matter that the owner wasn't the driver. I don't think it would help you to change adjusters. It could just be that the accident is so new that they don't have all the info yet, so give it a few days to see what new information you get. If you end up going to court, name EVERYONE you can think of as defendants: the driver, the owner, the insurance company, etc. Let the judge decide which of them owes you the money for your damages.
