How much will my insurance go up?

  • Will it be my fault if my car skidded and instead of hitting an oncoming car, i hit the railing and did private property damage? My insurance said it was. I have court appeal date next week, do you think they will say its my fault? If the court said its my fault, how much will my insurance go up by? Do you have an estimate? Our insurance does not want to give us an estimate yet so need some help

    It doesn't mater how the accident happened...Period! Whether someone ran you off the road, you swerved to avoid an animal...etc. If you are driving and cause ANY damage, you are responsible and liable for the expense. If you have insurance, you'll have to pay your deductible(if you have collision) to repair your vehicle and for any property damage that has occured. Most insurance companies have accident forgiveness up to a certain amount of damage(generally $1,000 limit), otherwise your insurance may go up 10-15%. If a police report was not filed and DMV does not have the accident on file, I would try to contact the owner and find out how much the damage is and pay out of pocket so your insurance doesn't go up. The judge will order you to pay the damages.

If you damaged a railing and if your insurance is paying to have the railing repaired, your insurance may go up but nobody here knows for sure. I do know who does know for sure though. Your insurance company. Ask them if you must know. As to fault. Who would possibly be at fault if it wasn't you? The car you did not hit? the railing? Yahoodee? If you have a court date, then you must have been issued a ticket. What was the ticket for? What are your grounds for appeal?

Usually, yes, it will be your fault. The logic is that, if you skidded, you were driving too fast for conditions, and the accident would have been avoided had you been driving slower. Even though you're at fault, your insurance company will usually be the one paying the damages (or at least part of them)... so the amount your cost will go up depends on how much they end up having to pay out.
