Speeding ticket and insurance help?

Anxious about speeding ticket and reporting to insurance in North Carolina. Please help!?

  • It's my little sister's first car - first time with insurance - and she just moved to North Carolina so I don't know how to assist her with this one. She was stopped going 40mph in a 20mph zone and has been advised to contest and get a lawyer or go to court because of the NC laws. However a lawyer/court fees run about $200 and the ticket is only $50. She's with State Farm or AllState (can't remember which). Is it worth it to get a lawyer or just pay the $50 bucks and take the hike in her rate? I mean, how much could the hike be?

You could simply call the insurance company annonymously and field the general question. Since it's not your ticket, you won't have to give any of your sister's personal information, you could just ask for your own knowledge. They'll ask for personal information, but since you don't have a ticket they can't put it on your insurance. And if not an exact figure, they may still be able to give you a ball park figure. And as for the 40mph in a 20mph, yeah you might want to talk to her. In VA the police have the authority to bring you in on a reckless driving charge going 20 mph over the speed limit. I know because I was stopped at 19mph over in a 55mph zone, and the officer warned me about it. As for the insurance, I don't know, I know in TX some places will give you mandatory defensive driving class to forgive the ticket if you plea no contest. I don't know if they do that in NC. I've gotten tickets in NC and I just didn't report them to my insurance company. But I heard that sometimes insurance companies find out about your tickets whether or not you report them. Oh I just remembered I got a ticket once and I was able to get them to cut it to a lower ticket and they said that it wouldn't get reported to my insurance company. But again I had a special circumstance where I wasn't able to go to court for it. Well good luck, if you have a friend that's a lawyer that would be willing to give you free advice, that's all I can think of.

Usually the insurance Company does not find out unless you switch to a new insurance company. Other than that they are already her insurer have no reason to check her insurance. If she has not switched insurance drivers licenses yet do it now before she goes to court it takes several weeks for it to go from the court to the Motor vehicle office. Get it switched over now if her license is from another state and the insurance. Do not mention the ticket. SHe has not been found guilty till court is over

It could be a lot - going 20 miles an hour over the speeding ticket is a major moving violation, not a minor one. Going to court, to get the ticket reduced to 15mph over the limit - or less - could possibly save her from having to pay high risk rates for the next three years, and getting her current policy cancelled. She really needs to talk to her agent, and ask them what happens if she has a speeding 20pmh over.

If she HAS NOT paid the ticket yet, traffic school (online or in person) is the best way to go!! no insurance fees and a reduction of the ticket cost. Also, a lawyer WILL PROBABLY get her off completely - but you need to weigh the costs of the lawyer vs. insurance hike. If you have already paid the ticket, there is almost NOTHING you can do. 20 over the speed limit is VERY BAD if you are 20mph over 55mph - that can get your license suspended.... but since she was 20 over in a 20mph zone, that is NOT toooo bad... answerer #1 is probably correct on the insurance - it is 2-3 points against insurance. Tell her to slow down :)
