Should I cash my check from AFLAC?

Do we cash the check or throw it away?

  • My car was hit and totaled by a woman that was looking at a store sign and did not notice traffic stopped. Her insurance company sent a man to my house to do an estimate on the repairs. He tried claiming that the vehicle was not that badly damaged and mailed me an estimate and a check for that amount. We brought it to a body shop. They said that they have dealt with this man many times and he is always a problem. They contacted him and told him that there was a lot more damage than he claimed. We then got a phone call stating that the they would not repair it since the damages were too much. We fought with him over what the vehicle was worth and even had to call his boss because he kept delaying giving us the check. Finally after calling his boss he met us and gave us the check but he never asked for the first check back. I figured that he would ask for it back. My question is... what do we do with the check? Should he have asked for it back? Am I supposed to cash it? Do they just cancel the first check and figured we would know? I do not want to get sued over the check if I am not supposed to cash it but I also do not want to throw it away if I was supposed to cash it.

    Definitely call the adjuster's boss and find out. If they voided the check and you cash it, they will come back to you to collect the money. So, the best advice is to call before cashing the check.

Call the insurance company to see if they will be cancelling the check and issuing you a new one or if you can cash that one and they will be sending you a second check for the rest of the payment.

Call the adjusters boss and ask. Chances are he was supposed to get it back, but you won't know until you ask.

Why dont you call him and ask him?

If they gave you a new one that covers the damages be the good person and rip up the first check.. If they call and ask what happened tell them it was destroyed and never cashed.

It sounds like the first check was a partial check for the partial estimate. The secondary check is the balance if they totalled it out.
