Who should file a claim with a transport company when a vehicle is delivered damaged?

  • I purchased a vehicle out of state via internet. The vehicle was delivered by transport with damage. Who should file the claim with the transport? The dealer or buyer. I purchased the vehicle for a fixed price with "FREE" delivery. The dealer selected, paid, and hired the transport company. The dealer is telling me that I have to file the claim and doesnt want to deal with it, but I dont think that this is true because I did not make the deal or pay the transporter.

    Ordinarily you inspect the car and file a damage report as soon as it comes off the truck. If you signed for the delivery without a damage notation and later discovered damage you're pretty much SOL. They will claim you damaged it after delivery and their proof is you didn't claim damage on arrival. I suspect the damage claims process will be specified by the carrier. With UPS either the shipper or the recipient can file a claim.
