How can I get the money for car stolen by friends?

I was at a gathering at a "friends" house on friday night. Their house is on a private road and they asked me whether they could drive my car up and down the private road, they claimed that they wouldn't get in trouble because it's a private road and the police can't do anything. I continued to say no and explained that I don't trust anyone with my car, not even my parents because my car means so much to me. Throughout the night we all got really drunk and i was in another room on the other side of the house, so i wasn't aware of what was going on. But my two friends, one a girl and one a boy, went into my bag, stole my keys and drove my car to go and meet another boy. When they met this other boy, he drove the car, the police followed the car because they must of thought it was a bit dodgy. My friends gave chase to the police, crashed the car and then the driver ran away on foot, so they didn't catch him. They arrested my two "friends" who are now out on bail. My car is in a holding bay where they keep stolen vehicles etc, they've had to keep it in because they are testing it for fingerprints to catch the driver. There are a few things that I am worried about. Firstly, i am worried that these "friends" have took drugs in my car, and if they have, will the police find traces of this, will they think it's me? Secondly, i was going to claim on my insurance for the damage to the car, but i can't do that now because my M.O.T ran out about a week ago and i wasn't aware of this, so now my insurance is void. How should I go about this situation? I am not very well off with money and i wouldn't be able to afford to pay for the damage caused. My "friends" are on bail conditions and are not allowed to contact me for 6 weeks as i am witness protection so how can I go about claiming money for the damage caused to my car?

As far as the insurance is concerned you ned legal advice as the lack of MOT should not invalidate it in this case as the MOT or not has no bearing on what happened. The car is recovered but held by the Police so you can do nothing until it is released. if there are traces of drugs in the car then that is nothing to do with you as you were not last to use it - the Police could use it as a lawful excuse to raid your home and search it if they wish. The 6 weeks will go on far longer as that is just to cover until the court case which could go on sometime and so it may be a year or more before they can"be spoken to". To get money from them you will need to use a solicitor as an intermediary and that will cost a lot of money so probably not worth it. Obviously, you now know to choose your "Friends" a lot more carefully

Your only recourse at this time is to file a lawsuit against your friends (and their parents if they are underage) and the driver as a person unknown to be named later. You don't need to wait until they are found guilty of a crime. They might not be charged and they might not be found guilty but the standard of evidence is much less in a civil trial. Other than that choose your friends more carefully in the future and be careful who you drink with to avoid a recurrence.

I don't know what to tell you regarding the money issue since it looks like your insurance can't cover you. I heard of people having their house burn down a couple days after they took the insurance off it, it sucks but it's reality, sorry to hear that. You shouldn't be, you're a victim of a car theft, clearly they're not yours, just explain that to the authorities and sound convincing. Everything in this story I read is in your favor basically. So they should believe you.

Believe me they are NOT your friends and your a fool if you think they are! Friends don't do that to each other. If you know the driver tell the police and also what happened. Your only being a fool to yourself if you don't. As for no MOT, sorry but it's your responsibility to make sure everything is up to date. For now you are off the road until you can afford to pay for the damage unless the courts make the thieving scum you call friends pay, which is unlikely as the UK legal system favours criminals! Live and learn.

I don't think you can - especially as you were also commiting an offence (no MOT). I think the only thing you can do is wait until they get found guilty abnd then bring a civil case againt them.

If the insurance is not valid ( check this out with your broker or insurance company) then you could bring a civil action against the person who drove the car. Even when you win the case your chance of getting any money out of them may be low. Many solicitors will see you free of charge for an initial consultation, so see a solicitor for advice.

Well these turned out to be good friends. First of all do you still want to be friends with these guys, if the answer is yes, then it can be a long drawn out process. 1st they took your car without consent, so therefore they stole it, this is where you can claim on your insurance for theft. 2 If you go along with claiming for car being stolen, then your friends will need to charged by the police for theft, driving without owners permission, no insurance and no MOT. This can carry an imprisonment sentence. 3 You are in a sticky situation they are your mates, but you know who took it, so if you go down the claiming car is stolen route, but when this matter goes to court and you are found out that you knew who took it, you could be done for perverting the course of justice and lose everything. So really you will need to think what you want to do, as for claiming for the repairs that might have to be funded by yourself, as you can't contact the guys who did it.
