How do I obtain my car title when the previous owner didnt title it?

  • Ok, so I bought this car from a lady who bought the car from a police auction and decided she didnt want to put the money in to repairing it. I went through the process of A. Filling out a bill of sale for the vehicle, B. Getting a Notary to fill out the paperwork to give me permission by the lady to do any neccessary paper work(title,registration), and C. Titling the vehicle in her name. The TN Dept. of Transportation took all that paperwork from me and told me that they would send her the title. It has been well over six months since then and the lady said she "never recieved the title." I need to know what I need to do to get the paperwork in my name?

    call your local DoT and ask them what's your status of your car and tell them what's happening so they can settle it for you.

Sorry, you can't. You go back to the TN department of transportation and ask what happened to the title, that she claims she never received it, and go from there. In the future, don't buy without a clear title present.

She probably threw the title out as junk mail if she's honest. But if she's not honest you should probably keep the car locked in a garage overnight..... you might find the car gone one morning, and THEY'Ve got the title !!!! So No Steal... scam... In your state there should be a legal procedure for cars that is equivalent to a "Quit Claim Deed" for real estate. You advertise in the Legal Section of the local newspaper for anyone having a claim against this car to step forward and present the claim to the clerk of the court within 30 days. The lack of any claim proves DE FACTO that the car is yours. Call your local county court and get the details for your state and county.
