I was in an accident. What am i entitled to? ?

I was driving on the interstate on xmas eve when i rear-ended a car stopped to avoid hitting an out-of-control truck. A miller lite truck, hauling a trailer full of beer kegs, lost control on the interstate- spilling kegs of beer and crossing all lanes of traffic before ending up in the ditch. The driver of the beer truck was ticketed for "towing requirements" (per the police report). I was notified by my insurance company that his insurance is going to accept responsibility. i only had liability and so i had to purchase a new car to get me by until i can get my car fixed. what am i entitled to? can i claim loss of use? can i claim the food that was in my truck and went bad? (was catered by hy-vee for an x-mas party that was absolutely ruined as a result of this accident). can i claim lost wages? I dont wan't to "cash-in" on this stupid accident, but definitely want what im entitled to. ive dealt with shady insurance companies before (ahem.. Geico)

You should contact a lawyer that will be able to help you with the case. Your insurance company will not necessarily assist you. They are just out there to make money. The lawyer will be able to act as a mediator between you and the insurance company and the other company. This is a bit of a difficult case with the fact that you rear ended a car while you were trying to escape the path of the truck. So at most you might get a 50% fault with the fact that yes the truck was swerving, but as a result, you rearended someone else.

Are you smoking some illegal substance? You rear ended someone else and now you want to sue? That is the reason insurance rates are what they are - people always want to make a buck at the expense of someone else. It was your fault - you rear ended another car - you should have been ticketed. You should have followed the car in front of you at a safe distance - that driver should be suing you. Let it go before you get sued.

You need to contact an attorney so that you get everything you are entitled to. I'm just shocked that you were not at fault for hitting the stopped car.

I read as far as "I rear ended a car" - and that pretty much is three strikes even before you step into the batter's box. If his insurance is accepting responsibility - I wouldn't push the issue at all.

I suggest you get a lawyer or the advice of one. you can certainly reclaim all of your lost expenses but the insurance co won't help you.

You rearended somebody, and they are accepting liability? Sounds odd to me. If anything, they will accept liability, but also deduct for your percentage of liability. You still failed to maintain control of your vehicle. Anyway, good for you if they accept 100% liability. If this is the case, you are entitled to recover for all damages. They will not pay you for the purchase of a new vehicle. They will reimburse you for what would have been reasonable rental for the time you were not able to drive your vehicle. They will have your vehicle appraised, and pay you for the damages. If the vehicle is totaled, you will receive the Actual Cash Value. Assuming you do not live in a state which requires PIP coverage, they will reimburse you for your lost wages, but usually only if you were injured and have a medical report from the doctor. Otherwise, you will not be compensated for the time you allegedly lost from work. Track down the receipt for the food and submit it for reimbursement.

So the insurer of the truck that went into the ditch is accepting liability for you rear ending someone else? I would go out and buy a lottery ticket if I were you because you are one lucky son of a gun. However if it's true that the beer trucks insurer is going to be responsible for your damages and the damages of the vehicle you hit then you would be entitled to have your vehicle repaired or the actual cash value of the vehicle, whichever is less. Since you purchased a vehicle instead of renting a vehicle you would not be entitled to loss of use. As for the food, was it ruined because of the impact or because you just left it in the vehicle and it spoiled? If it's the former then yes you can claim it under the trucks liability coverage, if it's the latter you may not be able to because you did nothing to try and preserve the food or find alternative transportation to get the food to it's destination. As for lost wages did the loss occur because of injuries you sustained in the accident?

LeAnne pretty much said it. If you rear-ended a car, your actually at fault. Driving laws and most insurance states that you need to drive at a "Safe driving distance" from other vehicles. I understand that there was an accident infront of you, but you didn't hit the truck, you hit a car that stopped for the truck. which means you either were not paying enough attention to stop in time, or were too close to the car infront of you to be able to stop. The rule basically makes it so that a car infront of you should be able to stop suddenly for an emergency and you should be far enough back to give yourself enough time to stop safely. So technically your at fault for your accident. You should be glad if you get anything.
