How much will this traffic citation cost me and how does the insurance work? (california)?
-
I just received a ticket for not having insurance while driving. Basically I hit the guy in front of me (small amount of damage to his car, nothing to mine), and he called the police. The policeman wrote up a "Traffic Collision Report" stating I didn't have insurance, etc., then wrote me a traffic citation (says it's an infraction) for not having insurance at the time. While this happened my mom was actually -getting- me in insured so I got insured maybe half an hour to an hour after the accident happened. The citation he gave me is just a "Notice to Appear" that says I need to go to court. What I'm wondering is am I going to have to pay the guys insurance company for damages and how much is the court probably going to make me pay for not having insurance at the time (I actually might have had insurance but I definitely didn't have proof on me).

Answer:
Insurance is usually from midnight to midnight. ~ If your mother bought it at the time you were driving you may be OK. ~ If your insurance was bought that day, take the certificate with you and explain you just didn't have it with you. Which is the truth.

Yes, you will have to pay his damages, and yes, you will have a fine to pay. You must have insurance to drive. There is no provision for "I will have it in 30 minutes so I don't need it now" in the law. You should not have been driving until you were insured. Not sure on the fine, I would guess in the $500 area though.

If the other guy has insurance it should have uninsured motorist coverage. Find out because that is what that coverage is for. I dont think his insurance goes up when he claims on that part of his insurance. When you go to court provide proof of insurance, and they will go light on you. The fine could be up to one hundred dollars. As far as you might have had insurance, remember insurance companies are sticklers with time frames to try to get out of any cost to them for the accident. If the other guy has a deductible for his uninsured motorist coverage (which is in any policy) you may be responsible for that. Best of luck to you
