[Aus] Help, I Got Into a Car Accident with no Insurance?

I got a car accident yesterday; my car (Toyota) rear ended the car in front of me (Honda). No injuries, no witnesses, no one call police. We exchanged the contact details and licences number. Both cars are drivable after accident and we left after we exchanged all the details. The Honda driver said her insurance company will call me. I am the car owner of my car, but my car is not insured (I only have the basic one (green slip?) required by law). For the other car (Honda), the driver said it's the car of her boyfriend's dad (not sure whether her name is included in the insurance policy) Can someone help me with these questions 1. If the driver’s name is not included in the insurance policy, will her company take any action and send a bill to me asking for money? 2. Who will pay for my car? The Honda’s insurance company, or the driver herself (whose name is not included in the policy)? 3. I haven't done anything so far, just wait for her insurance company give me a call. Are there anything necessary I should do right now? Thanks for any help, appreciated.

if you have no insurance and you rear end a car you are at fault. and its on you to pay for your damages, as well as those of the vehicle you hit.

1) Yes the insurance company should still chase you for the money. Seeing as you were the one at fault, it really shouldn't matter who was driving the Honda at the time. 2) You have to pay for your car. No car insurance company is going to pay out on a claim that they don't need to- and you were the one at fault- you need to pay for the repair of both your car, as well as the car you rear ended. 3) Start getting quotes on repairing your car.

You say you have no insurance but you also say you do. Something about "the basic one." Is that insurance or not? Please clarify. As far the the driver of the other car not being the owner, policies covered accidents if this person is authorized to drive the car by the owner. If you actually do not have insurance please sell this car and take the bus. Imagine if you had hurt this other driver! This is not being a responsible citizen.

Not the best situation. The other driver most likely had permission to drive the car, just like the permission, say, a mechanic has to drive a customer's car. However, without any official record, it's now that other driver's word against yours, with no proof as to who was at fault. In a legal sense, if you rear end another car and the other car did nothing to contribute to the incident, you or your insurance will be liable for damages to both cars. To be hard-nosed, you really can simply do nothing. To be fair, you are responsibility for all damages.

The "green slip" insurance you speak of is called "Compulsory Third Party Insurance" and only covers the medical expenses of persons injured in a car accident. Question One. ... It depends on the insurance policy that covers the Honda. Some policy's cover other drivers, some don't. If their policy does cover other drivers then their insurance company will send you the bill for fixing the Honda. If it doesn't cover other drivers then the owner of the Honda may choose to take you to court himself in order to recoup the cost of repairs. Question Two. ... YOU will pay for the cost of repairs to your car. Legally you are at fault because you ran into the rear of the car in front of you. You can't crash into someone's car and then expect THEM to pay for YOUR repairs when the accident was YOUR fault. Question Three. ... What you need to do now is start saving, because you are going to have to pay for all damages caused by you when ran into the car in front of you.
