Is this the American tourist's fault or the Chinese person's fault?

Would my insurance pay out if i was in a accident that wasn't mine or the other persons fault?

  • if it was my fault the crash happened or no ones fault it happened (it just happened) then i wont get any cover from any insurance.? if the crash was nobodys fault will my insurance still pay out to the other driver or not? if it was my fault then obv my insurance wud pay out and vise-versa.. but what if it "just happened"?

What are you blathering on about? If two vehicles collide there's always a reason. Someone was where they shouldn't have been or wasn't paying enough attention etc. Sometimes the insurance companies of both parties agree to go 50/50 on repairs because there was equal liability on both (or all) sides, but that's not the same thing. Crashes don't "just happen".

If your fully comprehensive you can claim for repairs to your car regardless of blame.

there will always be somebody at fault. the fault may not be clear, but they'll point the finger soon enough. otherwise insurance companies would go bust in no time.

In most, if not all states, insurance companies now rate accidents by percentage of fault. An accident where both parties are at fault equally would be a wash as far as pay-out to the opposite party. Each would collect from there own, so if no collision was carried no payment would be made (deductibles would apply). Medical no-fault and so on would apply if purchased and there were injuries. Any property damage to other property (fences, parked cars, etc.) would be shared. Accidents with both parties equally at fault are very uncommon. Almost always 1 party's actions contribute more and that person carries a higher percentage of fault.

Any time there is an accident, someone is at fault, accidents do not "just happen". The two insurance companies will investigate and decide who is paying what. In rare cases when they find both parties equally at fault where the money being paid out by each would be the same, they may tell both parties to pay for their own damages.

Every thing happens regardless but some one has to be in ''error'' for it to have happened so you and your insurers need to Analise every thing so you then know who's fault it was. Unfortunately if it falls on you your premiums will reflect this. You could ask the other party to go 50 50 assuming his / her insurers agree. That way you you share the consequences. Talk to your insurers, nicely!

i was in a collision with another car on a narrow road, it was the other guys fault and he had addmitted it was initially then the insurance company's got involved and they said as it was a country road that it would be a knock for knock which means that no party was to blame, and then the other guy claimed he wanted my ins to pay for his car being written off as when he hit mt 4x4 his car just crumbled ....... i was lucky as i had a witness to the accident who was cycling at the time he made a statement and i was awarded the claim this all took place over a period of 9 months for his insurance comp to setlle up good luck with that
