What happens if you are in a car accident and the other person is illegally insured?

My boyfriend was in a little fender bender, and the car he hit has North Carolina plates - we are in New Jersey. The lady claimed that it was her father's vehicle. No police report was filed, and 6 months have since passed since the incident. The lady has only recently begun contacting him regarding his paying for the car to be fixed, at a shop in New Jersey, 6 months after the fact. She has also stated in phone messages that the her is her own, yet she lives in New Jersey and the car has North Carolina plates. Additionally, where she lives in New Jersey boasts one of the most troubling parking situations in this most densely populated state, begging the question of how much damage may have already been present at the time of the incident, as well as any subsequent damages due to parking bumps. Quite a situation, I'm hoping someone out there will be able to lend some advice!

Claim it with your insurance company. Since we have "no-fault", your insurance company will cover it. You will have to pay $300 processing until your insurance company sues the other driver for costs, but you will get this money back eventually. Your premiums should not go up as the other driver caused the accident.

Technically if you move to a different state, you are required by law to have your drivers license and registration and insurance changed within 90 days. The hard part is going to prove that she isn't just "borrowing the car". Laws are different if you also do not live full time in a state such as if she is going to school there. The only suggestion I can make to you is have her send a picture of the damage she claimed happened when your boyfriend hit her, and he can verify whether or not that was what was done when he hit her. You also have the right to ask her to get 3 estimates for repairs that way he can compare what they are going to fix with what damage he did - that way you are not paying for something that may have happened after. If the damage she is claiming he did is not what happened, then your best bet is to file it with the insurance company and let them handle it. She may be out of luck that way for waiting too long to report it too.

If your boyfriend is liable for her damage, it does not matter if she has insurance, doesn't have insurance, lied about her insurance, Doesn't matter where she lives, where her plates are from, the color of her hair, etc. That has no bearing on the legal liability he has to repair her car. So you are looking into nothing really. Your boyfriend either needs to pay for her damage or turn the claim over to his own insurance company.

First off it`s always a mistake to not report an accident. Any non reported accident generally winds up as a he said she said situation later on down the road. First off are you absolutly sure that the boy friend was truly at fault? With out an officer there to apply the blame to the responsible party it could be either partys fault, wink wink. Also, why would the other party not want to report an accident if they were not to blame? Could it be that they have something to hide? Like no insurance or outstanding warrants, hmmm. I think I would try and run a bluff and tell them that you think they were equally at fault and each party should pay for their own damages. In todays economy more and more people are dropping their insurance.and or cutting costs any where they can. Just maybe they were not insure at the time of the accident or had their licenses suspended or were driving on a restricted licenses. It just dose not make sense for some one that is totally legal to allow an accident to go un reported. People just aren`t that kind any more. Also check the law in the state the accident happened in. Most states have laws that dicate how you handle an accident when and if one happenes. I live in a state where if the damage is over 300 dollars it is mandatory for the accident to be reported. Some states want all accidents reported. If the law in your state has been violated by both parties then if it gets reported now even if your friend is at fault both parties would get a ticket for a violating the reporting laws. So I would let the other party know that if they persist in doging you for the money I would now report the accident and cause them to get a ticket for not reporting it in the first place. Your boyfriend should let his insurance handle this. It isn't your concern how or where the other driver lives or is insured. She was the accident victim. Your boyfriend was at fault.
