Hi, Because the person was driving on a Provisional License the insurance becomes invalid, so it will be driving without a full license and no insurance. If the person had a fully licensed driver at the side of them then it it OK, (and L plates on) the person should get points on their license even before they have passed their test and a fine.Sometimes the car gets taken away, but i think that is only if the police catch you on the road. But beware the police will be looking out for this person so tell them to stay within the law. Next time they will throw the book at them. And probably confiscate the car. The police now have a device in their car's that tell them if the car is taxed mot and insured it can also tell them if the person has a full license.

Driving without a valid license in the UK will get you a penalty of 3-6 points (not sure how this works if you don't have a licence!!) and a maximum fine of £1,000. The court can also issue a driving ban which stops you from obtaining a driver's license for a set period in the future. You may also receive further charges of driving without insurance, as your insurance may be invalid if you do not have a valid driver's licence. I'm assuming you were driving with no licence at all - not even a Provisional. Don't forget, the driver is at fault, not the car! One further thing: under powers from the Serious Organised Crime and Police Act 2005, if the police believe a vehicle to be uninsured, they can seize that vehicle at the roadside and payment of a £105 has to be made within 14 days to secure recovery, plus storage charges (in some cases).

a fine if that is all you get stopped for but if you have an accident or cause one you could go to prison

I don't know but I think it should be a long period of imprisonment. Unqualified drivers have not had their driving ability assessed and may well be a danger to other road users and pedestrians.
