Car Accident Reports?

Two car, car accident. Same insurance, conflicted reports?

  • I had a car accident, first one in my 6 years of driving. No one's hurt. Same insurance. But what do you do when the insurance says it's a conflicted report? I said her light was red not green and she's sayiing the opposite thing. I believe the signal may have been in transition which is probably why we believe the signals to be different. This happened in brookyln on monday the 24th. Busy intersection, tight street. You know how narrow it can get. I'm slightly doubtful the light changed but it may have it was a green light. Only reason that I can think of why it's conflicted. My car was a nissian maxima, the other car was a Rav 4 The police report says the same exact thing no additional detail. What happens now? Does the insurance just call it an accident and pay us both? I don't mind if I have to cover part of the cost for my car as long as the insurance pays for the rest. The thing is the entire thing is now blurry to me. I was going straight she was making a right

    If there were no witnesses, the claims reps will likely consider this a 50/50 accident. If you have collision coverage, you will be paid less your deductible. Same with the other driver. Each claims rep will request 50% of your deductible back and then reimburse you that amount. This is handled internally.

Usually when this type of discrepancy arises if there are no independant witnesses and there is a constant conflict your insurance company may decide that it was a 50/50 fault. I would discuss with your insurance company your options. If this is the case then you will be rated at fault for an accident that stays on your record and you are rated for it for 6 years. You always have the option to pay back the insurance company your costs and then its not rated. Good luck

did you get a police report? i was rear ended at a stop sign and didn't get a police report. the guy who hit me lied and said that i backed into him. there was no police report or outside whitnesses so his insurance only paid for half of the damages because there was no way of "proving" who was telling the truth. good luck :)
