How much does my insurance go up if?

Car Insurance claim... not sure if it's my fault... how much will my insurance go up?

  • I live in California and got into an accident with a city bus. I was going to make a left turn in an intersection when the light turned yellow, so I stopped. The bus driver thought I was going to go through the yellow light, so he stepped on the accelerator and bumped into me. Is it my fault for stopping so quickly or his fault for bumping into me? If it's not my fault, will my insurance go up too? How long will it take to bring it back down? I got a hole in my bumper and I think I have to replace the whole thing. Will the driver's insurance cover for it? Thanks ^^

    What are you worried about? He hit you in the rear - it does not matter if you stopped quickly. You were attempting to comply with the law and not enter the intersection on a yellow light. That yellow light does not mean go thru, it means the light is about to change and that you need to clear the intersection. The bus driver was following to close because he could not stop in time to prevent a accident. Now I do believe that California is a no fault state; which means that your insurance company will repair your vehicle and the city bus company will repair the bus; after that; your insurance company will file suite against the city and collect for the damages to your vehicle. If you were not at fault and it sound to me like you were not. Than your insurance will not be affected in any way. No increase in policy.. If it would have been me; I would have went to the hospital to get a check up. Pain and suffering paids 3x actual damages to include, lost of use of vehicle, rental car, lost time at work, medical bills and repair of your vehicle. Wiplash is a funny thing you can feel ok the day the accident happened but the next day or two your neck can hurt like hell. Add everything I just mentioned up and multipy by 3 and that is what pain and suffering is worth. could have been well over $5,000.00 in your pocket. you should talk with a attorney, most of them will take the case for free and you pay only if they win. They usually get more money than you would. Sounds like your OK to me..

It's the fault of the bus for sure. No one can hit you in the rear. Even if you are just slowing down to look at something on the side of the road. You actually get protected by the law in this case. It's a stain when you get in an accident, it's hard to examine the evidence clearly for yourself, especially if the others make a big deal out of trying to act like it's not their fault. If the insurance company won't pay take them to court.

it is NOT your fault the bus was too close it don't matter what u did even if u stopped for nothing. the bus should have left a safe enough distance to stop. as if u had it the bus from the rear u would have then been at fault so make sure u claim for the damages off their inusurance and not yours. and also claim if u suffered any injury such as a neck injury. http://softwarez.bravehost.com/

The only way this accident was your fault is if you were going in reverse to get back out of the intersection. Just because you stopped "too quickly" does not make you at fault. The bus driver is to be in control of the bus at all times. He must have been following to close or something. Either way, whenever you get hit in the rear, it wont be your fault unless you were going backwards.

i think it was not your fault my mother in law got in the same kind of accident the light turned yellow except she was in the position of the bus and it was her fault. i also got into a similar accident where the light changed from green to red real fast near some railroad tracks and i rear ended a guy and it was my fault. We are both in Calif. too. It may take some time because it is a city bus but call your insurance company and tell them what happened. You must fill out a form within 10 days if the damage was over $500 you need to get this form from your insurance company. Also call the bus company and tell them what happened and get the info. for their insurance company then file a claim with them especially if you don't have full coverage. I hope you got a police report.

mostly it depends on your company. USUALLY if you get rearended its their fault, but not always. either way, its best to never say it was your fault.
