Car title in question buyer trying to get it back.?
-
A person bought the car for my ex fiancee( at the time fiancee) but they left it in the buyers name then a year later my fiancee forged the signature ( with permission of the buyer) but now she says she didnt say that And now ex fiancee is saying she doesn't remember. When she forged with permission to have the car in my name and grandmas. Does the orginal buyer have a good case. she bough the car for her (fiancee) but i have been taking care of it driving it 99% of the time. Paying for the expensive bills to keep the car running. ( i have recipets). and now ex fiancee has good hand writing and i ahve really bad so people can tell it wasnt me. But heres the catch i live on the meskwaki settlement I dont have to pay for tax on the car so no repcit was needed of me getting the car from the buyer. But as said before it was for the fiancee and she singed it still over to me. i ahve text proof except her admiting she forged. Even though she had permission, But if she goes for the car wont she ahve to go after my ex fiancee as well. for forgery so if she wants car back she will ahve to go after us both.? Now the buyer is saying hse has evidence that it was her car and wants it back.

Answer:
If you have a clear and current title that shows you as owner, you are the owner. If he has a case at all it would be against your ex for forgery, but if he decides to go that route he will have to convince the court he didn't know about it until now, almost impossible to prove. Stop texting them, and tell them if they think they have a claim to take it to court. If they do, get a good attorney.

You have a legal mess on your hands. Anytime you - or anyone buys a car - they should DEMAND a bill of sale AND a signed off title. Otherwise the sale is NOT official. Having a "verbal permission" to forge a signature does not cut it. Whoever has "given permission" can always deny it. Possession of the car probably does not cut it either. The prior owner can probably file a police report and say you have their stolen car - and the police will take it back. The laws of vehicle registartion are in place to prevent all this strife. If they try to take the car back - you will probably have to file a legal action to TRY and prove that it is your car.
