Will my insurance company pay for the damages to my car?

Car insurance company won't pay for damages.... any imput?

  • My friend bought a car. He has never driven it, and he did not have it insured. It had been sitting in the parking lot of his dorms (military) when the car parked in front of it had an electrical fire, and melted my friends car. It melted the front bumper, headlamp, and side fender. Geico (the other persons insurance) is saying that they are not responsible for the damages, and now my friend has to pay out of pocket to fix his car that another car damaged. Does this sound right to you? I would have thought that since the insured persons car damaged my friends car, that the other guys insurance would pay.

    They would not necessarily need to pay. The insurance would have to prove that the vehicle owner/operator was somehow negligent in the loss. A car can light on fire for a multitude of reasons, such as poor maintenance or a lit cigarette left on the seat (sad, but I've seen it)...in any case there would have to be physical evidence that linked the vehicle's operator to the souce of the fire. A fire report would have been filed for this amount of property damage. If it were suspicious either the fire dept or the insurance co could have conducted a fire investigation to find the source of origin...these are forensics tests to look for accelerants or electrical tampering. Frequently when a vehicle is a total burn there is no way of finding the source or origination as everything is toast. Your friend's claim would have been deemed a comprehensive loss, and most insurance companies waive the deductible for a total fire. If the claim has already been paid and nothing was due out of pocket from your friend...what does he hope to recover? The likelihood that GEICO would pay is slim unless we can connect the dots. BTW I work in claims and have a loss exactly like this...I am not paying it for the reasons described above. Our car caught fire, and even though I do think that's weird...there is no way of proving any type of negligence so I will not be paying for the other car. Best of luck. If your friend has his own Comp coverage, he should file this with his carrier. It should not affect his premiums as it is a non fault loss.

In order for Geico to pay for your friends vehicle the person that owned the car that burned up would have had to have been responsible for the fire. (Just being the owner does not make him negligent if his car starts on fire). Its kind of like if the wind causes a tree in my yard to crash on my neighbors house my insurance will not pay for it. I was not negligent for the wind causing the tree to crash on the house. This is the reason that they are not paying for his damages.

You're right, they should. Present them with pictures and a good explanation of the damages. Then, if they still refuse, contact the insurance board in your state. File a claim with them, against Geico. If that doesn't work, there isn't much you can do except get in touch with your local TV station, the one that does expose's and investigative reporting. Let them know that you tried everything and have not gotten your car fixed. Be prepared to show all the evidence as well as your buddy's car. It'll make something happen, nobody likes bad press, especially that little Gecko!

if he is not insured he is not covered, its not the other persons fault. its his own fault for not having it insured.
