How do I get a car title when the title is not in my name?

  • My brother bought a truck from a dealer and later decided to sell it to me. I made monthly payments to him and he paid the dealer. Years later the truck is paid off and I want to sell it to my friend, however, I never recieved the title after I finished making payments. I do not know the name of the original dealer, and my brother says that the company went out of business and he cannot get the title. How can I get a title to this truck? Does my brother need to fill out a lost title or can I? FYI- my mother seems to think that my brother got a lien on the title from capital one, but I do not know and brother has not said anything.

    Your local DMV office will have everything that you need plus you will need to take your brother there as well..

All your brother needs to do is to go to DMV and apply for a duplicate title. If the title has a lien listed on it, he will need to contact the lender and get a lien release. He can then sign it over to you.
