How much should a insurance company pay for a car accident that left me disabled for the rest of my life?
-
I have had 1 surgery and may need another on my back. I can no longer do the things i use to enjoy. I have a 7 year old that I can't do the things i use to do and should be able to. I'm now on pain management. The pain and suffering goes beyond just the usual. I just want to know what i should expect from the insurance company beyond my doctor bills?

I'm sorry to hear about your experience! How were you involved in the accident? Unless the insurance somehow was at fault (which I can't imagine it could be) then they're not responsible. That is why people have health and life insurance. Regardless, if you try to sue them (to collect money) you may have a hard case against you. So you could end up spending more money on court and lawyer fees. If you were injured by another driver's negligence (they were drinking and driving) you could try to sue their insurance company. People these days have become 'sue happy' b/c it's all about the money. If you need financial help then you should receive it, but at what point would you be happy? I wish you a speedy recovery! All the best to you and your child!

Get a good lawyer and you should expect a bunch, but withou a good lawyer you could get jipped out of a large sum of money that you deserve because not only do you need your doctor bills paid, you're out of work and aren't capable of paying your other bills like electricity and such, you deserve as much as you can get. My advice, please get a good lawyer!

so sorry to hear about your injury. each auto policy has a liability limit for bodily injury. for example the minimum limit in texas right now is $20,000. it can vary from there. the settlement will depend, in part, on the amount of medical bills which of course is going to be quite high with 2 surgeries and all of the other treatment you've undergone - sometimes an ER visit can exhaust coverage. your attorney and the insurance adjuster will have to negotiate what is fair for your pain and suffering. then the attorney will take their cut... so the amount that is left for you can vary. your attorney may also be filing a no-fault injury claim on your auto policy along with an underinsured motorist claim on your policy if the coverage on the other person's policy is exhausted. good luck to you

Have the lawyer help you figure how much money you would have been able to make until the date you would have retired plus the amount of pension you may have gotten after that. Also get a medical professional to estimate the long term costs of treating your condition for the rest of your expected lifespan. Then add a little for physical and mental suffering and sue for the total. It could take a few years to win but DO NOT SETTLE for no less than very near what you asked for.

Seriously, you need to ask your lawyer this stuff. They are getting 1/3rd of your settlement, make them earn it. You don't provide near enough info for anybody to give you any idea what your claim is worth. There will be a limit of how much you can collect. The at-fault party didn't have an open-ended policy with unlimited coverage. Automobile policies have coverage limits. If the at-fault party has an umbrella policy will also matter. That is info that your lawyer should be getting for you. The amount of coverage can vary greatly. You may also need to involve your own policy if the at-fault party didn't have enough to pay for the damages you suffered. If the surgery is accident related and you get the policy limits from the at-fault company, you need to see if you have Under Insured Motorist (UIM) coverage that may apply. Call your lawyer and make them get you this information. Good Luck
