Where is Speed Speaks?

Speed limits and speed limit signs and where they start,on where you increase your speed and be in the law?

  • i got a ticket today, and was given a ticket for 47mph in a 35mph zone, but where the officer was,was out in the country, inbetween some trees not 15 feet from a 45mph sign, this is where he clocked me,and it was back in town that the last sign said 35mph which was a mile and a half back, this part was in the country,i have always been told that if you can see the sign, and easily read the sign that that is where you can start to increase your speed, but as of on me i was 15 feet from the sign and his car was right by it

  • Answer:

If you are traveling in a 35 MPH zone, and you see a 45 MPH sign ahead, you MAY NOT exceed the 35 MPH speed until you have passed the 45 MPH sign. "I have always been told..." will not get you any slack from the judge

While there is always a little bit of leeway given to when the speed limit DECREASES (for example, if the limit goes from 45 to 35 mph, an officer will not be right behind the 35 mph sign and issue tickets. That does not stand up in a court of law). However, when the speed INCREASES, the increase is only allowed after you pass the sign. Your ticket is perfectly legal and will stand up in court.

The new speed limit starts exactly where the sign is. But either way, you were speeding even if the new speed limit already started.
