Car Dealership wants their car back after their store burnt down (this is long)?

So back in September my BF went and bought a used car from a dealership here in Texas. Then about two weeks ago they called us up and said "hey, we want to buy that old car back and we will give you 120% of it's blue book value." We asked them why they wanted the car back and they said that their inventory of used cars was getting low. So we go up there and they put the 120% of the blue book value of the old car towards the purchase price of the new car and give us a $5000 rebate on the new one as well. So we sign all the paper work give our old car back and drive off happy campers. Saturday night the dealership burnt down and they lost all of their paper work on everything. So they call us back today and say hey we need you to bring the car back TONIGHT so we can verify the VIN numbers on the car. Well my BF was working so I gather up my two babies and go over there so they can do that. Well they asked for the keys so they could go and check the VIN and when the finance guy comes back he says "well we need to take our car back because the financing didn't go through" So after long discussions on everything they said we had to take our old car back unless my BF could get a co-signer. The problem is that his dad was the co-signer for the used car we got from them the first time and they used him for this loan as well and now he suddenly isn't approved. They didn't have any paper work to show me and didn't have any paper work for me to sign to take the old car back. Then they gave me the car back and it had no licence plates and no gas. So I told them I couldn't drive it. They gave me temporary tags but the finance guy said he couldn't give me any gas because "they were closed now" I had just filled up the gas tank in the new car before I got to the dealership and didn't have any money. I told the guy that and he said "well I don't know what to tell you" and walked off. I told him I was going to have to walk home (it's cold and dark) and I have a newborn and a two year old daughter. And he ignored me. So I gathered my kids and started walking home. I don't live too far away from the dealership but still. It was far enough for me and my kids to freeze our butts off. The finance guy locked up the dealership and drove off, passing me by as I walked down the street. I am so furious and I have no idea what's going on. Everything with this deal seems shady. I'm so angry but I don't even know how to handle this situation. Any suggestions? I'm sorry this is so long.

Prosecute them to the fullest possible extent of the law. This is known as "Insurance Fraud" and they're trying to get all possible money from everywhere possible, from insurance to the customers, so you're getting screwed. Once you signed the papers to the car with the title and everything in your name, the car is legally yours, so technically speaking, you definitely need to get that car back ASAP and also press charges against them alongside with reporting them to insurance fraud. Take that company to the cleaners.

Your first mistake was to give them the keys. One can read the VIN number through the windshield. Bottom line: they stole the car, and your copy of the purchase paperwork will show that you have valid title. Call the cops, and prepare to prosecute.

They are trying to rip off not only the insurance company, but you as well. report them immediately and call the police, because basically the guy just stole your car.

First of all, dealers don't call and want to buy your car back because their "used car inventory is low". This was a sales trick to sell you a new car.

That's total BS. Don't you have some paper work to verify everything that happened that they let you drive off with the new car. I say if you have signed paper work then you don't have to give the car back. Go to small claims court if you have to and the media.

They've just commited insurance fraud, as the VIN can be read through the windsheild, what i would have just done was left, and told them to shove it up there ***. cause i mean if they lost all the paperwork and they said you didnt give the car back, what proof do they have that they sold it too you?,

You fell for that 120% trick? LOL. What do you want us to do? You tried to buy a vehicle that you all were obviously not qualified to buy and the financing did not go through! Be more realistic in your purchases next time. Verifying VIN numbers? You can't do that over the phone? Yeesh.
