What does it take to run a car dealership?

Can the dealership legally take my car back?, No Repo?

  • Okay i work for a car dealership and yesterday things got a little strange. I had traded in my old car to them which they sold. They pretty much sold it first before they sold me my new car. Now the customer who bought my car claims the "transmission is out". So my boss then mentions to me "Oh well i guess we will have to fix it and you pay for the transmission or take it back , and give you back your old car" (mind u now with a broken trans) So my question is, being i'm going to refuse to pay for the trans because they sold the car (that is now broken) and sold it"as is"(they also financed to the customer in-house) do i have anything protecting them from them taking my current car back? No bill of sale has been wrote for my new car. My new car is registered under a temporary plate in my name. They already registered my old car under a temporary plate for the customer who purchased it and i do have a receipt for my first payment made on the car I also get paid cash at this job.... I feel like i'm in a rough spot that i cant get out of, i should have NEVER got another car from them. This will be my last car from them.. Any help will be greatly appreciated i'm losing sleep over this problem!

    they can't do that. if your new car is registered to you and the other car is registered to it's new owner then you are done with the deal. they are just trying to push you into paying for it so they don't have to. however since there is no paper work who knows. if you stand strong and don't pay for it then i'm sure they will get back at you. i would start looking for a new job. if they are gonna screw employees like that i'd hate to be a customer.

They are trying to RIP YOU OFF. Refuse to cooperate in any way with this scam. You'll probably lose your job (who would want to work for a con man anyway) and they may threaten to take you to court over the issue (probably not) but DO NOT let them rip you off.

you do not have to take back the old car or pay for it because it is not registered to you. however since you mention a "first payment" im assuming you are paying the dealership for the car through a lease of some sort. The only way they can take the car back is if you don't pay your bill to them so save your receipts in case you need to prove later that you rightfully owned the car and paid for it

you are in a tough situation. you have little bargaining rights with the dealer having the ace card. i would see a lawyer

They are doing this because you work there. If you were a person off the street who traded and bought a new car, there is no way they could pull this off. You need to accept the fact that if you do not agree to do this, you will lose your job. Since you are paid cash under the table, they have NO obligation to you. You're like a free ink pen; useful but not valuable. Since everything is verbal, if they take back your new car, you have no legal recourse. There is no written proof the new car is yours. Everything is in the dealer's name and they have the legal ownership of the car. So, you will probably lose the new car. Your old car is now junk. Do you want to lose your job, too? I don't see how you are going to win this. They can unwind the broken car deal and sell that customer something else. That person will be OK. You will not be OK unless you can work out something with the dealer. But, I would fully expect them to let you go over this. You've made a lot of mistakes here, and the big one is trusting a used car dealer. I feel bad this is happening to you. Best of luck with whatever happens.

You and your employer are both screwed its a no win for anybody. You can keep the car and lose your job or you can pay to fix the car that someone else broke . I am sure that the dealer also broke some laws or rules he is regulated by the state , You both broke the law by being paid cash. The only way he can pay you cash is if you are an independent contractor and I guarantee your not. If your a mechanic and they buy the parts and pay you to put them on you are an employee If you detail cars and they buy the materials you are an employee.or reimburse you If you have set hours and they tell you how and where to work you are an employee If you sell cars you are an employee Ask your boss if a customer trades in a car does the customer provide him a warranty on it. When he buys a car from the auction or another dealer do they warranty it. I have lost a motor returning from the auction and I know its my problem ,not the person I bought the car from
