When is a car exempt from title transfer in massachusetts?

Can I transfer title of my car if Dad got third DUI three years ago?

  • My father's name is on the title of my car, due to a mix-up when we bought the car. We were going to transfer the title, but before we did my dad got a DUI, his third in less than ten years. According to Minnesota (where I'm from) law, "A registered owner may not sell a motor vehicle during the time its registration plates have been ordered surrendered or during the time its registration plates bear a special series number, unless the registered owner applies to the court that impounded the plates, for consent to transfer title to the motor vehicle." My dad recently filed for bankruptcy and though we get to keep the car, the plates have been impounded and I had to get my own car insurance. I would really like to be able to get the car into my name so I don't have to have my dad drive 7 hours to my school to get new plates. My dad says we STILL can't transfer the title because of his DUI, but that seems a little strange since it's been 3 years. Does anyone know if/how we can transfer the title of my car to my name without going to court?

    Call the DMV & ask them. Sounds like you may need court approval though. "unless the registered owner applies to the court that impounded the plates, for consent" It doesnt say unless its been more than 3 years.
