Does UPS pay for your Dental expenses?

I was hit by a UPS truck while riding my bicycle, what type of compensation can i get?

  • I was riding my bike to work traveling north on the sidewalk in front of a dealership when i saw a UPS truck drive out really fast to the exit. To the right of me the lane the cars are traveling is south, so as i was peddling up to the exit from the dealership where the UPS truck was i assumed he noticed me because he left a space in front of him as if to let me go by, plus there is no door on the right side of his truck so there was no way he couldn't have seen me, unless he didn't look both ways. Well i continued to peddle to pass in front of him because a car was coming south on the lane and i thought he was going to wait for that car to pass which would of been my opportunity to pass in front of him. Instead he hit his gas and knocked me off my bike but my foot got caught under the tire. He reversed and then leaned over to ask if i was ok. I said yes because my adrenaline was pumping and i was in shock. He let me go on ahead and he drove off. I got back on my bike and proceeded to ride, but then felt a sharp pain on my left leg. I later called my mother to pick me up and i went to see a doctor, i had to get an mri since the x-ray couldn't reveal anything. The mri cost $685 plus the two doctor visits so far which both cost $35. The mri revealed bruising on my foot and a micro-fracture to my knee, so now im in a leg brace. I so far missed 11 days of work and will miss another 25 or more until my knee heals. I called UPS and they said they will call me back tomorrow. I want to know legally what type of compensation can i get from this incident, can they pay for all my medical expenses? Can they pay for all the days i missed of work? Can they pay for my pain and suffering?

This is why riding a bicycle on the sidewalk is more dangerous than riding in the road. Drivers simply do not focus on the sidewalk when they're entering a roadway. They are too busy looking for threats in the road. Also, you were riding on the sidewalk against the flow of traffic, which multiplies the risk of not being seen by a factor of three, because the driver is looking for a gap in traffic coming from his left and is unlikely to check the sidewalk to his right before he pulls out into the gap. You were lucky you weren't killed. If riding on the sidewalk is legal there, you may have a case. If not, you were a major contributary cause of the accident and you will get nothing. In most places, riding a bike on the sidewalk is illegal - because it's suicidal. Unless you want to be killed, stop doing it! Ride in the road, where you are much safer.
