How do you make yourself a confident employee as a sales associate?

How do I make sure my sales rep is not considered an employee but rather an independant contractor?

  • I will pay them commission only, ask them to pay a nominal fee for any collateral used and not set them any work schedules. They can work as they please either PT or FT and will just get paid on a 1099 according to sales they close as an independant sales rep.

    It sounds like a good start to correctly classifying your sales people as independent contractors. Check out Publication 15-A and 1779 in www.irs.gov. They will help you make the classification correctly. There are very large penalties for classifying them incorrectly, so you want to be very sure.
