What web hosting company shall I go with?

If web hosting is in my name and my company name, and someone else designs my site, who owns it?

  • I live in Virginia, and my company is registered here as well. I pay for web hosting through Go Daddy for my company, which I am the sole proprietor for, I have a guy, who is/was my friend, things are tedious right now, who did 100% of the work for the website, but with my verbal guidance on what pages I wanted and how I wanted it. I had made minor grammatical revisions to this here and there, as well as some formatting... The thing is, now he is threatening to have our website shut down if we no longer have him work for us. My question now, is can he do this? He himself put at the bottom of each page "Property of *company name*, design by *his name*. All rights reserved, *company name* 2011... I have backed up all website files and removed his name from that little footnote. Thanks in advance.

Well...it really depends on the agreement made when you hired him. If you have it in writing, then go back and check the contract to see who owns the work, what duration is set, etc. If it was a verbal contract, with nothing in writing...well....it's your word against his in court, if it comes to that. If you own the hosting, you should be able to go in and change the password so he can no longer log in and threaten you. One solution is to take it down and replaced it with a different design. You can base it in the current one, but use different code, CSS, etc. I run a writing service, and I also do web work. My site is under construction, but get in touch at facebook.com/TheDiamondPen or thediamondpen [at] yahoo [dot] com, if you're interested. (FWIW, I turn over ownership on all my paid work...and put it in writing. So does every pro I've know.) You can tell your friend, "Thanks, but after thinking about it, I'd like it to have a different feel." The other solutions that come to mind pretty much all involve lawyers. :P

change the password and the domain and the web hosting account, and do whatever you like.

Whoever purchased the domain and the registration is the owner, regardless of what is said or agreed to outside the site. Otherwise, if your site isn't registered, anyone who might discover your login could claim ownership and any monetization. You mentioned that "things are tedious". If I can assume that this website isn't making any money, then just let it expire, and set up a new one. If you want to use it to generate monetization, I suggest you check into Mike Liebener's "Blogging Underground" system. It works for me. Friends only begin to quibble when one of two events happens: 1- the site makes money 2- the site doesn't make money Change sites and/or friends, and move on.
