Is it better to incorporate my nonprofit or not?

Is it better to register incorporate in MD, NV or MT?

  • I am looking to start a company and in form a LLC, and I'm wondering which is the best state to form in. What are the pros/cons to each state? (I'll be living in MT, btw) Some guys I do business with suggested NV and MD as good states to incorporate in, but I don't understand why.

Check with each state on how they define a limited liability company and what protection is offered for your particular business. There are some states that will give you more protection than others, but without understanding what it is you're doing, the question can only be answered by you. When you call the Secretary of State you might ask about the fees involved, their application requirements, renewal fees, time frames and penalties for late filings.

Lots of paperwork. LLC in Montana and NO sales tax if you have internet sales.

Frankly, there's not much difference, unless you plan on making millions. If so, register in NV or DE. Otherwise, register in your own state.

I live in Maryland and I can't figure out one benefit of incorporating here. Nevada has great privacy protection. Delaware has a lot of benefits as well. If you plan on having a large company, I'd go with either Delaware or Nevada. If it is just a small local company, stick with the state you are in.
