Is it fair to ask non-compete in family business if business success has never been shared or offered.?

  • My wife has a successful family business. i have clients from my business, which is not like-kind. my wifes sister has never offered any position or support from her business success and knows of my wifes physical limitations to make income. those limitations would not be hampered if any administrative duties were offered, in fact she excels and would generate more clients. i have offered to give my clients to her freely and she non-accepts reasoning being she has all the work she can handle; not interested. i have been offered compensation to send my interested clients to a competitor. my wife is upset that i would try to help a competitor, but her sister has had no compassion nor offered to assist her in her labor limitations. is it worng to take compensation for referral clients from a competitor if her sister has no compassion or empathy to offer any position or support and has no interest in servicing my clients reasoning her business plate is full?

    Non-compete agreements are only an issue if someone has signed a contract promising they will not compete. IMHO, non-compete agreements are never fair as they increase prices and reduce competition. If you want your customers to stay with you, give them a better deal than your sister-in-law is giving them.
