How to get a new job after suing previous employer?

• In August I decided to quit my job after almost 5 years. I spoke to my manager to give my two weeks notice but he made a couple of racists comment like 'don't quit because the korean owner will tell my korean boss not to hire anymore Mexican managers' I also found out the new Korean managers hired where working less hours and getting paid hourly while I was getting paid. My boss also made a comment on how if you didnt speak Korean you will not get a managing position in the company. There was also a big gap between entry level pay for Hispanic and Korean employees even when they had the same experience and education. After I quit spoke to a lawyer who told meI had a wage claim against my employer. The lawyer said I was misclassified as exempt and I could get money for the 15-20 OT hours I was forced to work each week. Now it's been 3 months and I been on a couple of interviews and haven't been called back. How can I avoid a bad reference from this employer it seems they are trying to get back at me for the lawsuit. They give me bad references even though they gave me above average reviews in all of my evaluations. How should I explain my situation to prospective employers and what do I put on reason for leaving on job applications.

  how do you know anyone is giving anyone bad references?? haven't you noticed the US has been in a major recession for 2+ yrs and there are 17 million unemployed people out there? job applicants to job openings are probably 50 to 1 and employers are only going to interview 2 or 3 people for each job opening - just put on application not to call that employer
