How to ask for medical leave?

Can a employer ask for medical verfication if employee submits a leave application on medical grounds?

  • Can one,as a employer, ask for verification of employee's fitness if a employee sumbits his medical leave application if employer doubts such thing?Who will bear charges for such verification?

  • Answer:

Not sure if verification is right word. Most employers have a sick leave limit, beyond which one has to produce doctor's certificate stating the illness. At my workplace the limit is two days. So for three days or more, there has to be medical certificate. Most doctors won't charge to issue such a letter or certificate when the patient has in fact been treated under them or is a family doctor.

Yes. You can ask for it if the leave is long to medium term (i.e. a week) or is an ongoing problem (i.e cancer, non- cosmetic operation etc). There are no hard rules on the matter but usually if it's a single day off and their not persistently taking days off sick then there is no need. However the law is clear you must provide ample time to allow them to produce it. So you can't demand a sick note "tomorrow at any cost" for example.
