How can i change the rental contract if i am the landlord ?

  • i have a rental house that i rented to 2 men using a standerd rental contract, and i did not specifie anything in the contract like no pets, no subleters, no extended visitors, no people making drug buys, no felons that the landlord does not no living in the house. i just used a standard rental contract, and now i wish i would of made a more strick contract, because i want to have more control over my own property, i live close to the rental property so i can see the bullshit that is going on, but now i think i have the upper hand, one of the men moved out months ago, and left the one man living there, and thats when i really seen things going to hell fast, they never did pay the rent on time i always had to remind them otherwise i would not get the rent, and trust me they would not remind me if i forgot about rent, when just the one man started renting it got worst, late rent every month, bad checks, allways having to remind him, are track him down, people moving in, visitors like crazy, and i am geting tired of it, i dont think renters forget to pay they hope the landlord will forget, i have really been taking this as a insult lately because i thought i was helping someone out, but then it just hit me this guy is trying to rip me off, he has no respect, now i think i may have the upper hand. he went out of town for a month for work and he owed me 3 month back rent, and his scum bag friend are staying in the house, the power company shut of the power, he never changed the power into his name, but used it for 3 months, and people were still living there. i served a 72 hour notice posted on the door and mailed a copy, there is no way he can get home in time to pay me, he makes me mad because he is allways trying to scam are lie, after i served him with the 72 hour notice 2 days later he called saying he is going to send 800.00 and give me the rest when he gets to town, this was on my anser machine, he did not say anything about all the people living next door, are about the 72 hour notice which i no his scum friends told him about, so by the time he gets back i will file the eviction notice. boom. i think him and his scumbag friends no more about the rental laws than they act and he is just seeing how much he can get away with, DO YOU THINK I HAVE ENOUGH ON HIM TO HAVE THE UPPER HAND THIS IS WHAT I GOT, 3 month back rent. 1 maybe 2 copies of bad checks 1 from rent past due for sure have this one, the power has been shut of at the house and it is a huge bill huge huge huge... thats right, i dout he is going to be very happy when he returns to see the notices but i think he allready nos, he is just a scammer, if he agrees can i make a new contract and let him stay, he is working now and i no i can get my money, i can allways kick him out later, I WOULD LIKE TO MAKE A NEW CONTRACT THAT IS VERY VERY STRICT, limit visitors, no subleters, inspections, make it a term contract, this is if he gives me what he owes me, i have other restriction on the contract too but i am not going to list them all. but it is not that bad it does not make it so bad for the tenant, now if they wanted to have crack heads stay over for months at a time, and have people dealing drugs out of the house, or people coming and going at all hours of the night it might suck for them. or if he plans on subleting to a bunch of low lifes while he is out of town.

    Well, you can file for eviction the moment the rent is late. Apart from that the contract is the contract.

Check with the statutes in your state as there are some rules that allow you to throw them out after 3 days notice but you'd need an attorney to write up the form and court paperwork for you. For instance it seems to me that you MUST have electricity. So I'd say if there is none then you can boot them out. Once you give them notice of eviction then your attorney will put the paperwork thru the court and the sheriff will come and make sure they are gone. You as the owner "always" have the upper hand. You can do a credit check and a criminal check prior to allowing your next tenants rent. And sure you can prepare your next rental contract as you want it. When people are renting there and have already signed a contract you generally aren't supposed to be allowed to change it till the year is up. I had a landlord change it on me and demand that I sign. I read it and it sounded ok to me so I signed the new one (because he had an additional person rent in the house and that seemed ok) but I didn't have to sign, but because it was his property (unlike rental units in a highrise) and if I didn't agree he would probably have made it tough for me and I'd have had to leave. Anyway you have lots of rights. Check with your attorney. You need that attorney this time. Maybe next time around you can do it yourself (if you save yourself a copy of the forms that are submitted this time).
